Copies of the Consolidated List and legislation referred to in this notice are available for consultation in the Secretariat. If import cannot be done within the prescribed validity period, the importer can apply to the BOFT for an extension of the validity. The use and quantity of the goods to be approved for import must comply with the scope provided for in the Montreal Protocol; only then can a special case approval be issued.

The applicant must obtain the documents required for the application from the competent governments of the relevant municipalities or provinces and from the Agricultural Council. The import licensing system is regulated by "The Tobacco and Alcohol Administration Act", "The Enforcement Rules of the Tobacco and Alcohol Administration Act" and "The Regulations Governing Undenatured Ethyl Alcohol", and is administered by the Ministry of Finance (hereinafter the "MOF").

An application will not be rejected for any reason other than failure to meet the prescribed conditions. An applicant who is rejected may file an appeal with the rejecting agency or appeal to its superior agency under the relevant provisions of the Appellate Law. Please refer to the governing regulations (see answer to question 5), which are available for reference at the Secretariat.

The details and document requirements relating to the application are set out in the applicable regulations (see answer to question 5) which are available for reference at the Secretariat. Upon arrival of imports, importers must submit an import approval certificate no. No deposit or advance payment is required for approval.

The validity of an import approval is 1 (one) month from the date of issue, but this may be increased or decreased by the agency that manages these import approvals when considering the needs of practical conditions. There is no penalty for not using an import approval or part thereof. The system applies to goods originating in and coming from all countries and customs territories, unless otherwise specified in the protocol of accession of the Special Customs Territory of Taiwan, Penghu, Kinmen and Matsu or the agreement on the conditions of accession to the WTO. Any repeal of the "Fisheries Act", "Transportation Act" and "Civil Aviation Act" would require the approval of the Legislative Yuan. In case of refusal, the applicant has the right by law to appeal by following the procedures provided for by law. For vessels, the application is submitted by the owner of the vessel or by the owner's agent. Details and documentation requirements relating to an application are set out in the applicable regulations (see the answer to question 5), which are available for inspection at the Secretariat.

For the actual import, an importer must submit the import authorization issued by the competent authorities. An import authorization for fishing boats, vessels and civil aircraft is valid for six months and can be extended if necessary. There is no penalty for failure to use an approval or part of it.

There are no other administrative procedures other than obtaining an approval document prior to importation.

FIREARMS, AMMUNITION, CONTROLLED SWORDS, SIMULATION GUNS, POLICE WEAPONS

Repeal of the "Firearms, Ammunition and Weapons Control", "Law on the Use of Police Weapons" and the "Administrative Law on Industrial Explosives" requires the approval of the legislative branch of the government, the repeal of the "Act Regulating the Licensing and Administration of Firearms, Ammunition and Cutting, of pointed weapons", "A measure regulating the licensing and administration of firearms, ammunition and cutting, pointed weapons" does not require the approval of the legislative branch of the government. To import “firearms, ammunition, simulation weapons, police weapons” or “controlled swords”, the importer must specifically contact the NPA, the Ministry of National Defense or a municipal, city or district police station for approval; to import 'explosives for industrial use', the importer must contact the Bureau of Mines of the Ministry of Economic Affairs for approval. In the event of a denial, the applicant has the right to file an appeal with the denying agency or appeal to an agency superior to the denying agency in accordance with the Administrative Appeals Act.

9.(a) To import “Firearms, Ammunition”, “Simulation Rifles” and “Controlled Swords”, an applicant must be a government-licensed business operator, user or individual; In order to import “police weapons”, an applicant must obtain an order for purchase by military authorities or police institutions. b) To import explosives for industrial use, the importer must obtain government approval for the manufacture, processing, sale and/or use of explosives. For “Firearms, Ammunition”, “Simulation Rifles” and “Controlled Swords”: a letter of application stating the name, quantity of the goods, country of origin, country of sale, purpose and use of the imported goods, and a power of attorney. For “police weapons”: proof of purchase from military or police agencies indicating the intended quantity to be purchased and a product description document.

For "Industrial Use Explosives": a letter of application indicating the type of explosive, quantities and import shipping port or airport of entry. When actually importing "Firearms, Ammunition, Simulation Rifles, Controlled Swords" or "Police Weapons", an import permit issued by the NPA, Ministry of National Defense or the Municipal, City or County Police Station is required, and an import permit issued by the Bureau of Mining of the Ministry of Economic Affairs is required for the import of "Industrial Use Explosives". Approval documents from the NPA, Ministry of National Defense or the Municipal, City or County Police Station, and the Mining Bureau of the Ministry of Economic Affairs are valid for six months.

For justifiable reasons, the original licensing authority may extend the validity of the import authorization documents.

TARIFF QUOTA: DEPARTMENT OF CUSTOMS ADMINISTRATION, MINISTRY OF FINANCE Outline of system

Issuance of tariff quota certificates is carried out according to the provisions of the Rules in question and is an administrative action in accordance with the mentioned rules authorized by the Law on Customs. Therefore, the removal of tariff quota certificates does not need approval from the legislative branch of government. The volume of the quota is set in accordance with the concessions made in the framework of the admission of Chinese Taipei to the WTO.

Pursuant to Article 16 of the aforementioned rulebook, importers may apply the tariff rate within the quota of the distribution method in advance for imported goods, while importers cannot submit certificates on time, but they may correct the procedure. for goods that have been inspected and released, together with the payment of a guarantee deposit equal to the amount of customs duty calculated at the rate of excess quota, and correct the procedure within the validity period of the certificates. Recipients who obtain a quota allocated by WTO members for the production of small vehicles are eligible to apply for a license. Applications are accepted for agricultural products according to the method of allocation of tariff quotas, which are carried out by order.

For the agricultural products under advance distribution method, the authorities will charge a performance guarantee or royalty while issuing the certification of the tariff quota. The performance bond will be returned to the holder after the holder has imported its total allocation before its certificates expire. For agricultural products under the pre-allocation method, the allocated quota can be transferred partially or fully within the validity period of the certificates, but not for small vehicles.

To transfer quota, both obligee and transferee must complete the tariff quota application form and apply to the original authority that allocated the quota for quota transfer and the performance bond, accompanied by the following documents:. a).
