Abstract
This study intends to compare the similarities and differences of the public kindergarten teachers’ rights and obligations between the ”Childhood education and care law” in Taiwan and the“ Nursery work procedure” in Mainland China through documentary analysis and comparative.
Based on the findings of the literature analysis, the results of the study are summarized as follows:
First, the similarity of legal rights of public kindergarten teachers between Taiwan and Mainland China are all emphasized to partake in the early education and care organizations, and to in-service training of kindergarten teachers.
Second, the public kindergarten teachers in Taiwan have the legal right to ob-tain the information about personnel matter rules, regulations and rights and to in-terest of their occupation, but who in Mainland China don’t have the right. On the contrary, the public kindergarten teachers in Mainland China have the right to par-ticipate in the invasion of kindergarten, the public kindergarten teachers in Taiwan don’t have the right.
Third, ”Childhood education and care law”establish the significance of the public kindergarten teachers in Taiwan firmly, who have the rights of appointed, treatments, in-service training and study, retire, compensation payment, severance pay, discharging with severance pay, insurance, partake in the early education and care organizations,appeal and litigation, who in Mainland China don’t have the rights.
Fourth, the similarity of the legal obligations of public kindergarten teachers between Taiwan and Mainland China are all emphasized to partake in the specia-lized thorough or in-service training, and must assure the kindergarten of secure and health.
Fifth, the dissimilarities of the legal obligations of public kindergarten teachers between Taiwan and Mainland China are included that the legal obligations to the public kindergarten teachers in Mainland China belong to the “restraint on specialty teaching” ,the legal obligations of the public kindergarten teachers in Taiwan belong to the “restraint on personal behavior.”
