考量各產業因本身產品性質及技術各異，對於專利權利價值的界定亦有不 同，換句換說不同指標對各產業有不同影響。本研究者可將專利侵權訴訟案件 以不同產業加以分類，而產業/技術分類指標則是以CHI Research 所制定的26 項產業領域之分類為參考，如下表10所示。本研究將其368筆訴訟專利樣本數依 表10之分類為歸類之依據，並於第四章實證分析中加以討論，這15項專利指標 在不同產業中影響訴訟賠償金額程度有何差異。
