These disciplines apply to measures by Members relating to licensing requirements and procedures, qualification requirements and procedures, and technical stan-dards affecting trade in services in sectors where specific commitments are undertaken. They do not apply to measures to the extent that they constitute limitations subject to scheduling under Article XVI or XVII.

本準則適用各會員於已作出具體承諾之服務貿易項下,有關核照要件、核照 程序、資格要件、資格程序及技術標準等之相關措施。本準則並不適用構成 GATS第十六條或十七條之限制的措施。

Measures relating to licensing requirements and procedures, qualifica-tion requirements and procedures, and technical standards shall be pre-established, based on objective and transparent criteria and relevant to the supply of the services to which they apply.

會員與核照要件、核照程序、資格要件、資格程序及技術標準有關的措施,

應於事前建立102(pre-established)、建立在客觀及透明條件之上,並應與 欲規範之服務提供有關。

Nothing in these discipline prevents Members from exercising the right to intro-duce or maintain regulations in order to ensure provision of universal service, in a manner consistent with their obligations and commitments under the GATS.

本準則不妨礙會員為確保「普及服務」(universal service),在符合其 GATS之義務與承諾的情形下,制定或引進新措施。

Ⅳ. TRANSPARENCY

Each Member shall ensure that measures of general application relating to licens-ing requirements and procedures, qualification requirements and proce-dures, and technical standards, as well as detailed information regarding these measures, are promptly published through printed or electronic means, or other-wise. Where publication is not practicable, such information shall be made pub-licly available. This information shall include, inter alia:

會員應確保與核照要件、核照程序、資格要件、資格程序及技術標準之措 施,與本措施相關之更詳細資訊,立即以出版物或電子或其他方式公布。如 公布實不可行,相關資訊應有公開的管道得以取得,尤其是;

(a)whether any authorization, including application and/or renewal where applica-ble, is required for the supply of services;

(h)where applicable, how public involvement in the licensing process, such as hearing and opportunity for comment, is provided for;

(j) the normal timeframe for processing of an application.

Each Member shall maintain or establish appropriate mechanisms for responding to enquiries from any service suppliers regarding any measures relating to licensing

requirements and procedures, qualification requirements and procedures, and tech-nical standards. Such enquiries may be addressed through the enquiry and contact points established under Article III or IV of the GATS or any other mechanisms as appropriate.

會員應建立適當機制,確保各服務供給者對於核照要件、核照程序、資格要 件、資格程序及技術標準等法規之各種疑問得到適當正確的回覆。上述疑問 得透過GATS第3條及第4條所建立的查詢單位及連絡單位,或其他適當機制 予以提出。

Each Member shall endeavour to ensure that any measures o general application it proposes to adopt in relation to matters falling within the scope of these disciplines are published in advance. Each Member should endeavour to address collectively in writing substantive issues raised in comments received from service suppliers with respect to the proposed measures.

會員應盡力確保(shall endeavour to ensure)受本準則規範之一般性適用措施 之草案,於事先公布。會員應盡可能提供服務供給者適當的機會對草案提出 評論意見。會員亦盡可能針對服務供給者之評論意見提出之重要問題「統 答」(address collectively)之。
