Abstract

Whether the "fishing expedition" ( Ausforschungsbeweis) should be forbidden has been discussed in Germany for a long time. But in Taiwan it is seldom discussed both in the academic community and in practice.

This is an area to be explored in Civil Procedure.

The so-called "fishing expedition" mainly refers to the situations which the litigant does not specify the theme of the evidence, but wishes the court to find out. Then the litigant can raise new issues or make new claims based on the facts that the court has discovered through the

"fishing expedition". The most disputable issue is that if the litigant's request for the evidence investigation is based on suspicion, should the court ask the litigant to offer a proper basis before accepting his request?

The issue of whether the "fishing expedition" should be accepted is involved with the conflict of rights between the plaintiff, the defendant and even the third party. It is also involved with many fundamental principles in the Civil Procedure. This paper is intended to explore these issues and then to design a system that allows the "fishing expedition" to be used logically and efficiently in Taiwan.
