Abstract
It has been a controversial issue as to whether the pre·
implantation genetic diagnosis (PGD) is prohibited under the German legal system after the promulgation of its Embryo Protection Act. The Federal Court of Justice of Germany (BGH) rendered a verdict on this issue for the first time on July 6 20 I 0. It recognized the legality of the PGD for the purpose of detecting serious inheritable diseases. This article, in addition to introducing the back ground of this legal con·
troversy and the verdict, will try to analyze the validity of the verdict from criminological perspective. This article argues that the punish·
ment of the PGD is a completely new issue and cannot be solved by applying the value indicated in the current German legal system. The ground that the BGH based upon to recognize the legality of the PGD is doubtful in terms of methodology. Nevertheless, the conclusion of the verdict is appropriate from the perspective of criminal justice as the PGD provides women a legal means to decide whether to have an implantation. It remains to be seen whether the German Parliament will adopt the BGH's point of view.
