能促成該產品市場上之獨占地位，侵權人之所得利益，也有可能是來自第三者之 競爭產品與市場利益，非皆屬權利人應得之利益；另一方面，若侵權行為人原有 之通路或市場能力相當強大時，因侵權而將該產品全部收益歸於權利人，其所得 之賠償顯有過當之嫌。是以，民國 100 年版專利法爰刪除總銷售額說之規定，將 損害賠償請求之範圍，回歸實際個案情況進行衡量計算。

然而，根據本研究之實證結果發現，總銷售額說之請求差距幅度顯著小於合 理權利金說，也因此，在原先總銷售額說損害賠償計算方法的操作下，相對於合 理權利金說，對專利權人損害賠償權利之保障程度較強。從這個角度觀察，此次 修法結果在操作上是否更有利於未來專利權人之權利保障，恐怕仍在未定之天。

是以，針對民國 100 年版專利法之修法結果，本研究建議，法院在判定損害 賠償範圍時，應利用民事訴訟法第 345 條之規定，在個案審判過程中促使侵權人 協助提出相關證據，以利個案損害賠償範圍之認定，保障專利權人之權利。

肆、 對後續研究者之建議

本研究礙於研究限制而無法就各種影響專利損害賠償判決結果之潛在變數 進行辨識與分析。因此建議未來研究者可藉資訊計量學(Informetrics)之方式分析 判決，結合資料探勘技術，篩選出各種可能影響判決之變數，以更為系統化的方 式建構專利損害賠償模型。
