SPECIFIC RULES OF ORIGIN

Section A

General Interpretative Note

1. A requirement of a change in tariff classification applies only to non-originating materials.

2. Where a specific rule of origin is defined with the criterion of change of tariff classification, and in its content the tariff code at chapter, heading or subheading level of the harmonized system are excluded, it shall be interpreted that the materials corresponding to those tariff codes have to be originating so that the good can be qualified as originating.

3. The excluded materials separated by comas and the conjunction (“or”) must be originating in order that the good may qualify as originating, whether one or more of the materials provided in the exclusion are used in its production.

4. Where a tariff heading or subheading is subject to optional specific rules of origin, it shall suffice to comply with one of them.

5. Where a specific rule of origin provides for a group of headings or subheadings, a change from another heading or subheading, such change may within and outside the group of headings or subheadings specified in the rule, as appropriate, unless otherwise specified.
