第二節 申請專利範圍結構分析

依據根據美國專利規範 37 CFR §1.75 (d) (1) “The claim or claims must conform to the invention as set forth in the remainder of the specification and the terms and phrases used in the claims must find clear support or antecedent basis in the description so that the meaning of the terms in the claims may be ascertainable by reference to the description.” , 因 此 藉 由 申 請 專 利 範 圍 結 構 分 析 (claim

construction) ,可以得知該篇專利之申請專利範圍是否得到了專利說明書的充 分支持,進而判定該專利的申請專利範圍品質及其有效性,此對於主張專利權 利範圍或進行授權談判將產生重大影響。下表10 為本研究之鑑價標的『蛋白質 表現系統』之技術所申請並已經獲證的美國專利 UA7524648 申請專利範圍 (Claim),本研究針對其申請專利範圍結構分析結果為:

該申請專利範圍(Claim)之保護標的計有『嵌合基因(chimeric gene)』、『蛋 白質表現載體(protein expression vector)」、「分離之宿主細胞(isolated host cell)」、「在宿主細胞中以增加之產率生產重組目標蛋白質之方法與在宿主細 胞中生產具有增加之免疫原性之重組目標蛋白質之方法(method for enhancing immunogenicity and/or solubility of a target protein or polypeptide in a host cell expression system)」、「表現目標蛋白質或多肽之方法(method of expressing a target protein or polypeptide)」。其中說明書已由實施例一至實施例十三(Examples 1-13)完整揭露上述保護標的之各項特徵。

根據上述分析,本項目符合 4 分之評分標準:同時兼具權利範圍廣、結構 之元件或製作步驟/流程的文字定義清楚、且結構元件之間的相對關係清楚、說 明書可充份支持 Claim 內容、且申請之權利範圍能確實掌握住其發明的技術特 徵。

e. separating soluble from insoluble proteins or polypeptides; and

f. isolating the soluble target proteins or polypeptides, wherein the yield of the soluble inherently more immunogenic target proteins or polypeptides is significantly greater that that from an expression vector without PTD and J-domain.
