131第 一 、 要 求 附 件 一 增 加 尚 未 開 放 的 中 央 層 級 機 關 。 然 加 拿 大 於 最 終 承 諾 並 未 配 合132。 第 二 、 要 求 於 附 件 二 列 出 加 拿 大 原 承 諾 會 提 出 之 10 個 省 及 3 個 地 區 機 關 的 最 終 清 單 。

第 四 、 要 求 附 件 二、三 機 關 之 服 務 採 購 應 涵 蓋 附 件 四 所 列 之 所 有 服 務。 對 此，加 拿 大 於 最 終 承 諾 並 未 完 全 配 合，蓋 附 件 二 機 關 之 服 務 採 購 並 未 涵 蓋 服 務 附 件 所 列 之 法 律 服 務（ CPC861，限 外 國 法 或 國 際 法 的 諮 詢 服 務 ）、會 計、審 計 與 簿 計 服 務（ CPC862）、 稅 務 服 務 （ CPC863 但 不 含 與 稅 務 相 關 之 法 律 服 務 ， ） 、 行 銷 管 理 諮 詢 服 務
（ CPC86503）、建 築 服 務（ CPC8671）、工 程 服 務（ CPC8672）、整 合 工 程 服 務
（ CPC8673 但 不 含 運 輸 工 程 統 包 服 務 CPC86731） 等 項 目136。 至 於 附 件 三 機 關 之 服 務 採 購 ， 加 拿 大 則 完 全 未 回 應 日 本 之 要 求 ， 仍 維 持 與 GPA1994 相 同 之 承 諾 ， 即 僅 限 聯 邦 級 的 事 業 單 位，服 務 採 購 才 涵 蓋 服 務 附 件 所 有 項 目；若 非 聯 邦 級 事 業 單 位 ， 則 服 務 採 購 完 全 未 纳 入137。
第 五 、 要 求 納 入 原 排 除 於 CPC51 營 建 服 務 採 購 外 之 「 疏 濬 」 及 「 交 通 部 之 營 建 服 務 服 務 」 採 購 。 然 加 拿 大 並 未 配 合138。
綜 上 所 述，日 本 確 有 斬 獲 者，僅 限 附 件 二 省 級 機 關 之 納 入，以 及 進 而 附 件 二 機 關 之 部 份 服 務 採 購 項 目 被 納 入 。
針 對歐 盟
139第 一 、 要 求 歐 盟 增 加 歐 盟 會 員 國 尚 未 開 放 的 中 央 機 關，並 具 體 列 出 其 認 為 各 歐 盟 會 員 應 開 放 之 中 央 機 關，包 括 要 求 丹 麥 及 葡 萄 牙 兩 國 應 將 目 前 清 單 中 所 列 之 中 央 機 關 下 之 所 有 司 ／ 處 皆 納 入（ 因 為 兩 國 在 部 分 中 央 機 關 項 下 列 出 特 定 司 ／ 處，似 意 謂 該 中 央 機 關 未 列 之 司 ／ 處 即 不 被 涵 蓋 ），以 及 要 求 其 它 各 會 員 國 納 入 司 法 機 關（ 如 最 高 法 院 ） 與 國 會 機 關 。
對 上 述 要 求，歐 盟 於 最 終 承 諾 僅 新 增 法 國 最 高 上 訴 法 院 及 參 議 院、芬 蘭 最 高 法 院

第 六 、 要 求 將 附 件 二 之 「 貨 品 」 與 「 營 造 以 外 之 服 務 」 的 採 購 門 檻 由 355,000SDR 調 降 至 200,000SDR，附 件 三 的 則 由 400,000SDR164調 降 至 200,000SDR；然 美 國 皆 未 配 合 調 降165。
第 七 、 要 求 移 除 原 總 附 註 第 7 項 排 除 日 本 貨 品 ／ 服 務 以 及 廠 商 參 與 太 空 總 署 的 採 購166、 以 及 第 9 項167排 除 日 本 貨 品 ／ 服 務 以 及 廠 商 參 與 附 件 三 中 負 責 電 力 生 產 及 配 銷 之 機 關 的 採 購 兩 項 歧 視 日 本 之 規 定 。 然 美 國 於 最 終 承 諾 中 皆 未 移 除168。
綜 上 所 述，日 本 僅 於「 納 入 所 有 中 央 機 關 」、「 開 放 國 土 安 全 部 下 的 運 輸 保 安 署 」與「 特 定 各 州 下 屬 機 構 名 稱 」 等 要 求 上 ， 獲 得 美 國 部 分 回 應 ； 其 它 對 美 要 求 ， 則 完 全 未 獲 滿 足 。
日 本之 綜合 評析
日 本 之 初 始 要 求 相 較 於 歐、美、加，算 是 企 圖 心 較 小 者，因 為 其 不 僅 缺 少 作 為 最 高 指 導 方 針 的 共 通 要 求，而 且 特 定 要 求 中 有 不 少 也 只 是 為 增 加 附 件 之 明 確 度 與 使 用 之 容 易 度，並 不 涉 實 質 市 場 開 放 利 益。儘 管 如 此，其 自 其 它 四 國 所 收 到 之 回 應，同 樣 有 限。尤 其 是 其 認 為 最 違 反 協 定 不 歧 視 原 則 的 針 對 日 本 的 互 惠 性 排 除 ， 歐 美 依 然 維 持 不 動 。
不 過 根 據 日 本 經 濟 產 業 省 於 2012 年 6 月 4 日 發 布 之 「 『 2012 年 版 不 公 正 貿 易 報 告 書 』 及 び『 経 済 産 業 省 の 取 組 方 針 』」，日 本 對 於 2012 年 修 正 協 定 市 場 開 放 談 判 部 份 之 評 估169， 或 可 說 明 其 為 何 也 願 支 持 談 判 告 一 段 落 。對 於 此 次 市 場 擴 大 的 成 果，其 舉 出 包 括 日 本 在 內 的 五 國（ 也 正 好 是 本 報 告 分 析 之 四 邊、外 加 韓 國 ）所 為 之 貢 獻170：日 本 在 貨 品 與 服 務 採 購 門 檻 的 調 降 、 並 增 加 靜 岡 市 等 七 個 政 令 指 定 都 市 的 開 放 ， 美 國 增 列 10 個 聯 邦 機 關 、 歐 盟 新 增 約 160 個 中 央 政 府 級 機 關、加 拿 大 納 入 所 有 省 政 府 的 採 購、韓 國 在 貨 品 與 服 務 採 購 門 檻 金 額 的 調 降 以 及 納 入 3 個 特 別 市、及 廣 域 市 的 採 購。是 以 儘 管 其 要 求 有 許 多 未 獲 滿 足，但 這 些 新 增 的 中 央、與 地 方 機 關 採 購 所 帶 來 的 商 機，顯 然 也 有 相 當 價 值，而 使 日 本 認 為 結 束 諮 商 並 無 不 可 。
結 論：歐、美、加、日 四 國 自 四 邊 之 其 它 國 與 韓 國 所 獲 得 之 回 應，與 初 始 要 求 間 其 實 是 有 相 當 落 差。儘 管 不 可 否 認，再 有 談 判 實 力 的 國 家 也 不 可 能 於 談 判 中 全 拿，然 而 如 此 大 的 落 差 、

如 此 有 有 限 的 要 求 滿 足 程 度，四 邊 仍 願 支 持 談 判 之 完 成，應 是 四 邊 與 韓 國 最 終 承 諾 所 新 增 的 開 放，綜 合 起 來 仍 代 表 相 當 之 商 業 利 益，另 外，早 日 結 束 諮 商，可 以 加 速 刻 正 進 行 中 的 中 國 加 入 談 判，甚 至 吸 引 更 多 具 有 廣 大 採 購 市 場 利 益 的 國 家 加 入（ 按 GDP 排 名 前 15 的 國 家 尚 有 中 國、巴 西、印 度、俄 國、澳 洲 及 墨 西 哥 尚 未 加 入 政 府 採 購 協 定 ），未 嘗 不 是 另 一 種 擴 大 政 府 採 購 市 場 的 良 方 呢 ！
(二 ) 委 員 會 未 來 工 作 計 畫
儘 管 截 至 本 計 畫 執 行 期 限 結 束，委 員 會 相 關 工 作 計 畫 並 無 任 何 公 開 的 具 體 進 展，但 掌 握 各 工 作 計 畫 形 成 之 原 因 以 及 相 關 背 景，對 於 未 來 追 蹤 各 工 作 計 畫 之 發 展，以 及 提 供 我 主 管 機 關 對 各 計 畫 參 與 立 場 之 草 擬 仍 有 相 當 助 益 ， 故 以 下 分 別 討 論 之 。
I. 「 中 小 企 業 」 工 作 計 畫 （ GPA/113, pp. 439-441）
背 景：部 分 締 約 成 員 於 開 放 清 單 中 填 載 政 府 採 購 協 定 不 適 用 於 其 國 內 法 之 保 護 中 小 企 業 措 施，以 致 其 保 留 相 當 部 分 採 購 案，而 不 開 放 予 其 他 締 約 成 員 之 廠 商 競 標，
結 果 或 引 起 其 他 會 員 仿 傚、或 出 現 要 求 其 修 改 此 部 分 之 聲 浪，因 此，委 員 會 有 檢 討 各 締 約 成 員 於 採 購 時 援 引 中 小 企 業 政 策 或 措 施 之 必 要 。 於 訪 談 WTO 秘 書 處 官 員 時 亦 獲 證 實，並 表 示 此 計 畫 之 緣 起 乃 因 歐 盟 關 切 美 國 政 府 採 購 中 之 中 小 企 業 保
