劃方案，嘗試參考國際立法趨勢來因應共享經濟議題，惟本研究認為考量到 立法制定過程冗長，難以隨社會變遷與時俱進；適用寇斯定理所需的財產權 明確劃分要件，亦需經過法院個案認定或立法規定，同樣會產生規範時間上 的落差。此外，共享經濟所涉及的範圍遍佈各行各業，如欲妥善立法或規範 必然得就各行業特性做分析觀察始可為之，無論對立法者或執行單位均會造 成極大負擔，實行上確有難處。
因此，本研究認為現階段政府對Airbnb 議題所能採取最有效率的作法，
是在貫徹共享經濟與Airbnb 利用閒置資產的共享精神下，確立我國對共享模 式房源定義與標準的內部共識，向Airbnb 進行溝通協商，以我國所達成的共 識作為標準，在平台上建立實名登記、房源規模限制、居住事實證明等門檻，
並配合評價、舉發制度作為篩選機制。接著，透過行政機關函釋或以行政命 令的方式，針對Airbnb 個案放寬解釋現行法規，制定相關罰則與限制以解決 交易糾紛，並在相關函釋或行政命令做成之前，藉由Airbnb 內部的社會規範 制約使用者行為。
此作法除符合行政院所要求的低度管理、業者自律、開放思維的態度外，
將監督權交還給Airbnb 使用者，亦可降低執行成本、提高效率，對 Airbnb 平台與政府所增加的負擔較低，較不易因雙方合作意願不足而協商破局。此 外，縱然於函釋或行政命令做成前的短租行為仍屬違法，然如我國已達成內 部共識，且於Airbnb 平台上所建立的門檻確實阻擋不當房源，而僅存共享模 式的住宅共享，亦可主張短租行為乃私人財產的使用收益範圍，藉由法院判 決、民眾輿論，加速促使Airbnb 突破現有法規限制於臺灣合法營運。
第二節 研究建 議
本研究係以Airbnb 作為個案，採質性研究分析共享經濟所面臨的困境與限制，
企圖歸納共享經濟的特徵並作為臺灣因應共享經濟議題的參考。然針對Airbnb 短 租行為採取尋租行為的相關資料多以外國文獻為主，我國的反對力道僅止於對 Airbnb 的合法性撰文表示懷疑，並宣導民眾評估風險小心為上。此現象是否表示

臺灣對於Airbnb 的接受度是否較外國來得高？原因為何？實屬值得探討之處。
是故，本研究認為就質性研究方面，後續研究應可加入使用者、Airbnb、政 府單位三方的深度訪談，透過三方觀點歸納出臺灣民眾以及政府單位對於Airbnb 的想法與態度，並以此為中心進行政策建議的修正；若以量化研究來說，後續研 究應可對透過問卷調查臺灣使用者對Airbnb 的了解程度、使用狀況，以及對旅館 民宿產業的影響程度等資訊，以調查結果來判斷Airbnb 是否確實產生外部性以及 影響範圍，再據以提出政策建議，將更具說服力。
此外，由於各國對於Airbnb 的合法性均有所討論，然因立法過程冗長且繁複，
未能於本研究完成前達成結論或訂定專法公布實施，我國的虛擬世界法規調適規 劃法案即為一例。故後續研究可拉長研究時間軸，在未來其他地區就Airbnb 議題 表達觀點或訂立管制方法，抑或是爭議事件暫告段落後，以較為完整宏觀的角度 分析Airbnb 所面臨的困境與限制，可能會得到更深入且具說服力的結論。
最後，本研究主要以我國現行法律適用情況作為分析對象，然Airbnb 或共享 經濟均為全球性擴張，勢必需因地制宜的討論各地區所涉及的爭議。且因各地區 的價值觀與風土民情均不同，是否會影響到對Airbnb 的接受度及合法性，亦是值 得探討的議題。
