The term "skyjacking" means the unla wful seizure, or attempted seizure. of control of an aircraft in flight by a person on board through the use of force, threat, seizure of aircraft. n Aircraft hijacking" is the term employed in the draft proposal for a protocol to the 1963 Covention on Offences and Certain Other Acts Committed on Board Aircraft (Tokyo Covention ) which was submitted in January 1969 on behalf of the United States to the Subcommittee on Unlawful Seizure of Aircraft of the Legal Committe of the International Civil Aviation Organization. W@ In United States v. Cordova (1950) 89 F. Supp.298, the District Court for the Eastern District of New York found itself without jurisdiction to punish a man charged with assaulting the pilot, the stewardess and another passenger even in an American aircraft flying over the high seas between Puerto Rico and New York. In order to remedy this deficiency Congress passd a Statute in 1952 and, as spectacular aircraft crimes (notably "hi-jacking") continued to take place, the law was strenthened in 1961. In Regina v. Martin (1956) 2 Queen's Bench 272, Justic~ Devlin held that "any offence wha tever committed on a British aircraft.
