應不 予保 障其 既有 合法 使 用權 。 如不影 響國土、保 安者則 得保障其 既有合法之使用權，其包含修繕、改建、新建等。
又清境地區之危險區位（第 2-4 級）大部分位於清境農場週邊 之遊 憩、 零 星 乙 種 及丙 種 建 築用地 上 ， 而國土保育 地區 依 環 境敏感 程度 作為管 制 依 據 ，遊憩用地之限制應比農牧用地嚴格才是，因此，
本研 究建 議對 於國 土保 育 地區 下 既有合 法使用權之 保障應 為一致，
皆應 經國 土計 畫主 管機 關 同意 才 能 繼續原有 使用 ，以符合公平正義。
三、後續研究之建議
(一 )本研 究鑑 於時 間與 人力 因素下 ， 僅以南投 縣清境 地區為案例 ， 對 於該地區之課題探討分析，並提出適宜之土地使用模式，以作為國 土保育地區土地使用管制研擬方向之參考，對於其他類似地區土地 使用管制之問題可能未能全面處理或解決，建議後續研究可納入其 他類似地區之研究案例，建立更完整之國土保育地區土地使用管制，
以兼顧資源保育與土地利用。
(二 )本 研 究 係 針 對 清 境 地 區 之 研 究 內 容 主 要 在 於 環 境 敏 感 程 度 及 土 地 使用管制，劃分出可發展、條件發展及限制發展區，以提出適宜之 土地使用模式。然而，本研究對於該地區交通、水源等問題並未深 入探討、解決問題，後續研究如能對於交通、水源等問題擬定處理 對策，以促進土地更有效利用。
