第三節、未來研究的建議
本研究關注高智的成立背景，專利資源整合與產業市場之間的專利策略，並 聚焦於國外文獻範圍，由於過去國內中文相關論文的文獻並不多，故在論文架構 建立上幾乎全部沿用國外的論文文獻，參酌政府和高智的網站資源新聞報導作為 參考整理，但是很多商業策略運用不是有單一標準答案，並且會受到社會、政策、
文化等外在因素影響，所以極有可能因為取得資料皆為媒體新聞，或者是高智官 方網站聲明，而出現難以合理解釋之處，並且很多結論也往往只是外界對於高智 的臆測。
在研究方法上，最初希望可以採用深度訪談的方式，擴展論文關注的層面，
只是在受訪對象的選擇上，多是職位階級高層主管人士，非常不容易親近接觸，
也曾經遇到無法透露企業機密為由的拒訪情況，再來台灣企業對於專利法律爭議，
到最後往往以和解授權金落幕，台灣企業與高智的授權契約內容，動輒得咎影響 外界對於企業股價獲利率的預估，此涉及公司機密的敏感話題，受訪者可能礙於 身份職位不便，也無法做出具體陳述，或是掩蓋實際真相，盡量以正面、刻意修 飾過的「官腔」說詞來作敷衍。礙於研究者自身人脈管道有限，建議後續研究者，
可以取得重要的訪談資料，再分別與報章新聞說法比較，相互參照所有說法。或 者利用例如以實習身分或者從業人員的身份直搗黃龍，直接進入田野，除了能更 有機會接觸其他重要受訪者與獲取更多一手資料外，也能進行長期性的觀察研究，
讓專利商業策略運用研究分析能更深入透徹。
本文以高智公司作為分析標的，收集最初公司成長背景，存在的價值目標，
如何因應現行專利環境，和最重要的訴訟資料文件。當然截筆至此，這個大型專 利體仍處在進行式的成長，研究者礙於時間與人力、物力之限，即便是在 westlaw 法學資料庫的訴訟資料也不全然完備，僅能就現階段的法學二手資料狀況進行資 料蒐集與瞭解，釐清高智專利佈局策略的不同階段發展進程，與媒體資料分別探 討對照。因此建議未來研究可對高智後續的發展，繼續跟進觀察後續演變過程，
甚至能針對其不同階段再分別探討與對照，並且更全面性地探討整合。
另一方面，高智與企業的策略聯盟關係，亦是值得再行深究的議題方向。尤 其國內外科技企業，已經有多家公司公開地與高智簽署專利交互授權契約，故企 業與高智在彼此資源付出與取用之間的微妙關係，也會是影響未來專利商業綜效

的重要關鍵。站在企業的立場，該怎麼與高智策略聯盟，進行合作協調與專利佈 局配置才是集結智慧財產資源的最佳運用？基於互利雙贏的共識原則，企業又如 何能在整合內外資源的同時，確保自身才是專利價值的最大獲益方？企業面對高 智又該如何保護自身專利財產發明價值？這些問題癥結點實在與高智的經營管 理緊密相關，建議未來研究者加以關注，進行更多延伸性的研究。
最後，本研究以單一公司作為案例，受限於個案特殊性，無法全然推論至所 有專利事業體的經營情況。未來可以進一步地延伸研究範圍，與國內外其他的專 利事業體類似案例相互比較，試著理出最基本與共通的參考模型。總言之，建議 未來研究者能在相關議題多加著墨，於專利技術與法商整合領域之內結合業界實 務的現象，有不同層次與方向承接發揮，作更進一步的探究。最後統整起來之成 果，相信能對往後新興專利爭訟議題和企業經營管理課題有所助益，累積豐厚資 源整合與綜效議題的學術成果。
