1.實務上,土地使用計畫(公共設施、可建築土地)之滯洪系統目前 尚無明訂之原則性檢核方式(蓄洪空間、面積、區位等考量)。
2.目前排水管理辦法規定土地開發利用、變更使用計畫時,始提送 排水計畫書,然此時都市計畫皆已完成審議,相關土地使用分區亦 已經各主管機關核准變更完畢,即使要求調整排水計畫書內容,亦 難達綜合治水之實質目的,惟目前水利署正研議要求開發單位於都 市計畫階段即提送排水計畫書,建議可洽詢相關資訊。
執行面 承上,有無相關機制運行並檢討?
土地使用變更大致分為土地規劃、開發審議、辦理變更及建築許可 四階段,現階段水利署日前(102 年 5 月 14 日)正研議於「土地開發 利用」及「變更使用計畫」時,分兩階段提送「排水計畫書」予水 利機關審查,相關決議目前尚未定案。

都市計畫及都市設計現行管理為何?
日前(102 年 5 月 14 日)水利署研議可於「變更使用計畫」階段考量 開發計畫之可供滯洪用地比例,其後再於「土地開發利用」階段檢 討其滯洪設施配置及操作原則等;惟相關規定目前尚待建立。

後續建議可洽詢經濟部水利署以追蹤其最新發展作為本案參考。
日前(102 年 5 月 14 日)水利署研議方向與本案相關之內容略以:參 照水利法之排水管理辦法第 11 條:「於排水集水區域內辦理土地開 發利用、變更使用計畫或其他事由,致增加排水之逕流量者,應將 排水計畫書送該排水之管理機關審查同意後始得辦理」。針對此管 理辦法,水利署欲加訂部分規範細節,如下所述:
1.有關土地開發利用之適用面積範圍,參照「中央管區域排水計畫 書審查作業要點規定」,擬定義為 2 公頃以上之開發面積,惟開發 面積部分仍可能有下修調整之必要。
2.建議排水計畫書區分為「變更使用計畫」、「土地開發利用」兩階 段審查,並分別於「受理變更前」及「開工前」提送排水管理機關 同意,確實流量管制之精神。
3.地方政府多數尚未訂定此規定之相關審查程序,未來將考量是否 修正「中央管區域排水計畫書審查作業要點規定」以擴大應用至各 級地方政府。
