Abstract "Knowledge-based Economy" and "Globalization" have recently become hot topics among academic and popular discussion. Mainstream discourse seems to anticipate and welcome a new millennium brought forth by this new economy. Is knowledge-based economy really fundamental1y different from economies of earlier eras? Or is it still inherent in capitalistic logic, only different in forms? ­ It is often postulated that knowledge-based economy is different from economies of earlier times, leading to a drastic change in employment relationships. Labor subordination and exploitation in traditional employment relationships will cease as a result. And knowledge workers will command power no less than that of capitalists, so that interest conflicts formerly between the two give way to partnership. To be specific, will labor loyalty obligations end following the termination of the employment relationship? Or is it still remained? If it is remained, then what is its rationale? This paper argues that post-employment non-compete clause not only hurts labor per se, but also is detrimental to optimal utilization of manpower as a whole. In addition, it is not the most effective means to help maintain a fair-competition industrial order. But if the situation involves workers in public research centers or official organizations, then the above arguments need some qualifications. Specifically, non-compete clause can apply to a certain extent in order to protect and promote industry-wide interest.. Keywords: knowledge-based economy, post-employment non­ compete clause.
