Abstract
In 2010, the Executive Yuan initiated and approved the ”Plan Of Improving the Sporting Circumstances and Establishing the Sporting Island”, and the mid-term strategies included building many sporting centers over the state. The Council for Economic Planning and Development further suggested that the execution and construction should be based on the type of Operation and Transfer(ROT)provided in “Act for Promotion of Private Participation in Infrastructure Projects”. In performing this plan, the Sports Affairs Council of the Executive Yuan decided to assist several civil townships to build the sporting centers, except the originally planned county(city)governments. This aroused many discussions and disputes in the executive proceeding, but there is no final conclusion till now. As a citizen of PingTong City, I wish to see a happy ending, so I study the legal basis of the township/city’s’ participation and analysis the concerning problems. This work aims to answer the followings: What is the legal basis of the township/city to participate the Infrastructure Projects? How to dissolve the legal problems arising from the allocation process of the required land owned by other government and the setting of the contributing royalty from the use of the land? And Finally, I will try to make a practical and available suggestion to the authority for future law making and problem dissolving.
