合理的教育政策形成歷程應該包含三種制度化的論辯機制

一、教育政策形成的實用論辯：教育政策形成的實用論辯之範圍，在於教育問題 之認定以及形成可行的方案，公民在此形成並且實現某些既定目標和價值偏好的 合理性方案，釐清事實層面的問題，測試教育問題之認定以及解決方案的所依據 的理由是否中肯，提供下一步就解決方案作價值判斷的合理基礎。

二、教育政策形成的價值論辯：價值判斷涉及人際之間的利益衝突，由於利益衝 突的根源不同，進入不同的價值論辯澄清問題，分別是(一)、教育政策方案牽涉 過多的利益，以至於無法明確區分利益衝突的正確根源突，進入教育政策形成的 公平談判。(二)、教育政策方案與社群價值之間產生衝，進入教育政策形成的 倫理論辯。三、教育政策方案所涉及的利益，是否能夠公正無私的調節各方共同 生活的質疑，進入教育政策形成的道德論辯。

三、教育政策形成的法律論辯：公民最後要進入教育政策形成的法律論辯，討論

公民所抉擇的教育政策方案，一旦付諸實現，其與現行法律體系的關係，用以確 保新舊規範之間具有融貫性，以及一致性。
