第二節後續研究建議

根據RPX 於 2015 年觀察，除了手機及電腦產業外，舉凡其他例如工業工程/建築、生技、醫療器材、商業/顧客服務及汽車產業等，都有可能是 NPEs 下一波訴訟攻擊目標。本研究從九大產業的地院訴訟案件中也發現網通產業、LCD 產業及LED 產業，相較於綠能產業及精密機械產業，暴露在 NPEs 訴訟風險下的機會是更大的。

為此，後續研究建議可由以下四方面著手：

第一、根據本研究目前已經建立智慧型手機產業和筆記型電腦產業的實證研究方法，繼續國內九大產業(尤其是網通、生技醫療及 LCD/ LED 產業) 之 NPEs 訴訟風險評估，為電子產業以外的國內品牌商建構完整預警。

第二、 NPEs 著重於技術競爭市場，PEs 則著重於產品競爭市場，兩者在 AMC 判斷基礎上有相當大的差異。本研究從產品競爭觀點切入，建議後續研究可以再從技術競爭觀點結合九大產業品牌商訴訟案例的持續累積，建立資料探勘預測台廠訴訟可能發生時機。

第三、在專利分析資料庫開發部分，建議未來系統開發商應於專利權人欄位，

同步收錄專利所有權人權利移轉歷程、移轉事件發生時間、利害關係人 (Assignor/Assignee/Exclusive licensee)等資料，降低分析數據失真。以 AMC 觀點來看，改善資料庫可以協助使用者在不被發現的情況下，以更加節省成本的方式消除潛在競爭對手刻意營造的煙幕。

第四、近幾年美國推出諸多專利改革法案不利 NPEs 發展，而未來歐洲統一專利 (Unified Patent)制度生效後，各國訴訟費用趨於統一可望降低歐洲訴訟成本，

預見未來幾年全球 NPEs 在歐洲提告的機會將明顯提升。以 AMC 觀點來看，後續研究建議可延續本文在美國NPEs 的訴訟風險實證基礎，持續蒐集國內品牌企業與歐洲NPEs 的互動過程，若能藉由第一手的觀察資料，

或許可以得到競爭者雙方更精確的動機形成過程。
