系列保持社會秩序和管理社會空間的框架(Butler, 2009)。
在新興的批判法律研究文獻中，也存在著許多法律與地理學之間的跨學科聯 繫，例如在城市管理層面中，法律在具體城市議題中的作用為何，包含鄰里關係、
住宅政策或公共空間的管理等等(Butler, 2009)。在法律與地理學科的交叉點上，
將繼續產生批判法律學術研究的新領域，而這都有助於我們對於現今空間與法律 間權力結構的理解。
第三節、結語
以美國次貸危機為背景的研究中，Marcuse (2012)之研究焦點是批判城市理 論運用至住宅政策中，其發現美國夢中，關於擁有房地產的意識形態內容包含75：
1. 租賃是不安全的，因為你有可能被房東趕走；
2. 對於不安全租賃的替代方法是以及價格便宜的所有權；
3. 這種價格便宜的所有權保證不受限制地使用，而且未來可以獲利；
4. 房屋價格正逐步上升，因此房屋財產的佔有似乎是安全的；
5. 所有權是家庭累積資產的安全方式；
6. 擁有一幢房屋的經濟價值表彰了一個人辛勤工作的證明，這同時也是道 德與個人的成就；
7. 房屋所有權的誘因之一是稅務制度上的補貼；
8. 而且任何類型的支持性集體或公共所有權和住宅設施的應該是最小限 度的。
75 正好與華文化中有土斯有財的觀念相似。

這種想法導因於美國的住宅大多由市場供給，不僅對有經濟能力的人，而且 對那些工資和資源在財政上不足的人來說，也是如此。但是房屋終究是滿足居住 的需求，不能把它當成一筆投資，不能利用這種財富為自己賺取利潤。住宅的商 品化是住宅問題中的根本，商品化所帶來的結果是讓房屋不再是一個人的生活必 需品，提供一個人生活的居住、安全保護、隱私、個人與家庭生活，而是成為一 個透過買賣而賺錢的工具。商品化把一種生活必需品，轉化成因為可以交換利潤，
以便人們可以從銷售，管理和融資中賺錢。
於是私人住宅市場系統在 2008 年產生次貸危機，但是這並非市場出了問題，
反而是因為其正常運作導致的結果。住宅只提供給那些能夠為其供應商賺取利潤 的人，這種制度的結果造成明顯的不正義。因此，限制住宅的商品化特徵有助於 解決住宅危機。該研究最後指出，要解決這個問題，首先必須建立完善的租賃房 屋制度，讓房屋租賃者亦可享有安定的生活，作法諸如租金的控制，將不公平交 易形式化，針對出租者的驅逐為法律控制，以及建築法規修正。再者，國家必須 積極介入監管房屋交易市場，削弱私人市場在住宅提供的主導地位，亦即傾向否 定房屋為商品的資格，土地的價值是由社會創造的，其所有權的利潤應該積累至 社會集體，而這必須是經由治理機關分配而非私營部門(Marcuse, 2012)。
最後，居住正義的達成，本文認為並非單純由適足居住權的權利保障，那可 能淪為社會邊緣人對國家的搖尾乞憐。而是應以城市權理論談起，城市住民必須 取得城市剩餘價值分配的參與權，作為城市發展的參與者與規劃者，其居住權才 得以實現，而這仍需要仰賴持續不斷的政治運動。
