System), 2017 Edition, Volume One (Contents) 265

1. 「貨物名稱及編號協調制度」，以下簡稱「協調 制度」，是由世界海關組織所制訂，作為多種用 途的分類法，可供海關及統計當局、進出口人 士、運輸業及其他與國際貿易有關的人士及機構 採用。雖然香港不是《協調制度國際公約》的締 約成員，但是香港已於1992 年 1 月 1 日起全面 採用協調制度。

1. The Harmonized Commodity Description and Coding System, or Harmonized System (HS) in short, has been designed by the World Customs Organization (WCO), to serve as a multi-purpose classification suitable for use by customs and statistical authorities, traders, carriers and others concerned with international trade.

Although Hong Kong is not a Contracting Party to the International Convention on the HS, Hong Kong has adopted the HS in full for trade declaration purposes since 1 January 1992.

2. 協調制度規定以 6 位數分項為貨物的分類，作為 國際間比較的標準。個別國家／地區亦可依照本 身的需要，增添貨物編號的數字，作更詳細的貨

物分類。「香港貨物協調制度」（簡稱「港貨協制」）

採用合共 8 個位的貨物編號分類系統。加添的第

七及第八個位是用作更詳細的貨物分類，以配合 本地的需要。第一套全面採用協調制度的港貨協

制為1992 年版港貨協制。其間，因應貿易模式及

技術的變更，而每年作出修訂。所有的修訂已經 在政府憲報刊登。

2. While the HS specifies the commodity classification up to the 6-digit subheading level for international comparison, individual countries/territories are free to use additional digits for more refined classification to meet their specific needs. The Hong Kong Harmonized System (HKHS) uses an 8-digit classification system.

The additional 7^th and 8^th digits are used to further breakdown the commodity classification to meet the needs of Hong Kong. The first set of HKHS, which adopted the HS in full, is called the 1992 edition of HKHS. It has since then undergone annual amendments to reflect changes in trade patterns and technology. These amendments have been announced in the Government Gazette.

3. 在 2014 年，世界海關組織對協調制度作出 233 項 的修訂，及後於2015 年則作出額外 9 項修訂，並 要 求 各 《 協 調 制 度 國 際 公 約 》 的 締 約 成 員 在 2017 年 1 月 1 日及 2018 年 1 月 1 日分別實施該 233 項及 9 項修訂。為了使香港的貨物分類制度能 繼續與主要貿易夥伴一致，香港將於2017 年 1 月 1 日起實施世界海關組織提出的共 242 項修訂。該

修訂版將名為2017 年版港貨協制，會全面採納世

界海關組織所建議的修訂，有關的修訂主要是為 了配合 (i) 全球關注的環境和社會議題；(ii) 科技 的發展；(iii) 國際間貿易模式和方式的轉變；及 (iv) 闡釋文句不明確之處，以便劃一協調制度的 應 用 。 請 參 閱 於 政 府 統 計 處 網 站 (www.censtatd.gov.hk/trader/declaration/index_tc.js p) 有關由 2016 年版改版至 2017 年版的修改摘 要。

3. In 2014, the WCO recommended 233 sets of amendments to the HS.

An additional 9 sets of amendments were further recommended by the WCO in 2015. Contracting parties to the International Convention on the HS are required to adopt these 233 sets and 9 sets of amendments as from 1 January 2017 and 1 January 2018 respectively. To ensure that Hong Kong’s commodity classification system continues to be compatible with those of its major trading partners, Hong Kong will implement all these 242 sets of amendments recommended by the WCO with effect from 1 January 2017. The amended version of HKHS will be called the 2017 edition of HKHS. It has fully incorporated the WCO’s proposed amendments which cater mainly for (i) environmental and social issues of global concern; (ii) technological progress;

(iii) changes in international trade patterns and practice; and (iv) clarification of texts to ensure uniform application of the HS.

4. 本刊物詳細刊載 2017 年版港貨協制的分類表。此 外，填寫進出口報關單時所需要的其他分類表，

如國家／地區分類及運輸方式分類亦包括在內。

大部分港貨協制的貨物條目亦配上一個數量單 位。

4. This publication details the classification list of the 2017 edition of HKHS. In addition, other classification systems needed for completing import and export declarations, namely classification of countries/territories and classification of transport modes, are also included. A unit of quantity is also assigned to most of the HKHS commodity items.

5. 根據進出口（登記）規例的規定，凡將物品進口、

出口或轉口的人士、除豁免報關物品外，必須在

物品進口或出口後14日內向海關關長遞交一份資

料正確及齊備的進口或出口報關單。報關單應該 透過電子資料聯通服務遞交。根據規例，海關關 長有權為審查報關單的資料，要求任何人士就其 遞交進出口報關單提供文件及證據。規例亦列明 提供不全面及不正確資料的罰款。

5. Under the Import and Export (Registration) Regulations, every person who imports, exports or re-exports any articles other than an exempted article is required to lodge with the Commissioner of Customs and Excise an accurate and complete import or export declaration within 14 days after the importation or exportation of the article. Declaration should be submitted through Electronic Data Interchange service. In accordance with the Regulations, the Commissioner of Customs and Excise is empowered to call upon any person who has lodged an import or export declaration to verify any particulars given in the declaration by the production of documentary or other evidence. The Regulations also prescribe penalties for the supplying of incomplete or inaccurate information.

6. 當填寫進出口報關單時，進出口人士必須採用本 刊物刊載的適當港貨協制編號及數量單位。透過 閱讀協調制度的一般闡釋準則及每一類和每一章 開始時的註釋，可以加深了解港貨協制。

6. When completing import or export declarations, importers and exporters must use the appropriate HKHS codes and units of quantity published in this book. For a thorough understanding of HKHS, the General Rules for the Interpretation of the Harmonized System and the notes at the beginning of each section and chapter should be carefully studied.

7. 附錄一的食品附表所載的食品，在進口報關時，

每張報關單劃一繳費二角。附錄二是成衣製品附 表，此類港產品出口須繳付製衣業訓練徵款。

7. At Appendix I is a schedule of food items, the import of which is subject to a flat charge of 20 cents per declaration when an import declaration is lodged. A schedule of clothing items is at Appendix II. Domestic exports of these items are subject to a Clothing Industry Training Levy.

8. 進出口人士應該在 2017 年 1 月 1 日起，採用 2017 年版香港進出口貨物分類表（協調制度）所 刊載的港貨協制編號及數量單位，填寫進出口報 關單。有關的規定將於適當時間在憲報刊登。

Importers and exporters are advised that the HKHS codes and units of quantity provided in the Hong Kong Imports and Exports Classification List (Harmonized System), 2017 Edition should only be used for completing import or export declarations as from 1 January 2017. This will be announced in the Gazette in due course.

Any reference to goods of a given material or substance shall be taken to include a reference to goods consisting wholly or partly of such material or substance. The classification of goods consisting of more than one material or substance shall be according to the principles of Rule 3.

3. When by application of Rule 2(b) or for any other reason, goods are, prima facie, classifiable under two or more headings, classification shall be effected as follows:

(a) The heading which provides the most specific description shall be preferred to headings providing a more general description. However, when two or more headings each refer to part only of the materials or substances contained in mixed or composite goods or to part only of the items in a set put up for retail sale, those headings are to be regarded as equally specific in relation to those goods, even if one of them gives a more complete or precise description of the goods.

該最近似的貨品所適用的項目內。 4. Goods which cannot be classified in accordance with the above Rules shall be classified under the heading appropriate to the goods to which they are most akin.

This Rule does not, however, apply to containers which give the whole its essential character;

However, this provision is not binding when such packing materials or packing containers are clearly suitable for repetitive use.

2. （A） 可歸入第五十至五十五章或項目 5809 或 5902 的貨品及混合兩種或以上紡織原料 的物品，應當作全部只含其中最重的紡織 原料分類。

2. (A) Goods classifiable in Chapters 50 to 55 or in heading 5809 or 5902 and of a mixture of two or more textile materials are to be classified as if consisting wholly of that one textile material which predominates by weight over any other single textile material.

如沒有一種紡織原料的重量較大時，應把 各同樣重要的原料按項目編號排列，並以 編號最後的來分類。

When no one textile material predominates by weight, the goods are to be classified as if consisting wholly of that one textile material which is covered by the heading which occurs last in numerical order among those which equally merit consideration.

（B） 根據上述規定： (B) For the purposes of the above rule:

（a） 捆捻馬毛紗（項目 5110）及金屬

紗（項目 5605）均應當作一種單

一的紡織原料，重量以其成分的總 重量計算；把梭織物分類時，金屬 線應作為一種紡織原料計；

(a) Gimped horsehair yarn (heading 5110) and metallised yarn (heading 5605) are to be treated as a single textile material the weight of which is to be taken as the aggregate of the weights of its components; for the classification of woven fabrics, metal thread is to be regarded as a textile material;

（b） 在選擇適當項目時，首先須決定章 數，然後是章內的適合項目，無須 理會任何不歸入該章內的材料；

(b) The choice of appropriate heading shall be effected by determining first the Chapter and then the applicable heading within that Chapter, disregarding any materials not classified in that Chapter;

（c） 如第五十四及五十五章與其他章 數有關連時，第五十四及五十五章 應當作一個單一章處理；

(c) When both Chapters 54 and 55 are involved with any other Chapter, Chapters 54 and 55 are to be treated as a single Chapter;

（d） 如一章或一個項目所指的貨品含 不同紡織原料，這些原料應當作單 一種紡織原料看待。

(d) Where a Chapter or a heading refers to goods of different textile materials, such materials are to be treated as a single textile material.

（C） 上述（A）及（B）段亦適用於下列註釋 3、

4、5、6 所指的紗。 (C) The provisions of paragraphs (A) and (B) above apply also to the yarns referred to in Notes 3, 4, 5 or 6 below.

（B） 例外： (B) Exceptions:

金屬線加強的紗除外； (a) Yarn of wool or other animal hair and paper yarn, other than yarn reinforced with metal thread;

(b) Man-made filament tow of Chapter 55 and multifilament yarn without twist or with a twist of less than 5 turns per metre of Chapter 54;

（c） 項目 5006 內的蠶膠絲及第五十四

章的單根連續長纖維； (c) Silk worm gut of heading 5006, and monofilaments of Chapter 54;

（d） 項目 5605 內的金屬紗；以金屬線 加強的紗是遵照上述 (A)(f)段的 規定；及

(d) Metallised yarn of heading 5605; yarn reinforced with metal thread is subject to paragraph (A)(f) above; and

（e） 項目 5606 內的繩絨線、捆捻紗及

縱行起圈紗線。 (e) Chenille yarn, gimped yarn and loop wale-yarn of heading 5606.

本類。 10. Elastic products consisting of textile materials combined with rubber threads are classified in this Section.
