五、新加坡的兒少個人資料保護與教育

新加坡的個資保護主要基於新加坡個人資料保護法（Personal Data Protection Act, PDPA），該法案於 2012 年發布並分階段施行，作為企業收集與利用個資的最低限度要求（林秀蓮、李世德，2014），發布至今已歷經數次修正；法案內容主要關注「同意（consent）」、「目的（purpose）」與「合理性（reasonableness）」。

企業必須告知目的並獲得當事人的知情同意，方可收集、利用與揭露個資。此外，

目的必須合乎情理（Personal Data Protection Commission, 2020a）。民眾懷疑或確認其個資被濫用時，均可於新加坡的個人資料保護委員會（Personal Data Protection Commission, PDPC）的網頁進行舉報。新加坡個人資料保護法並未針對兒少訂定個別的保護規定，倘企業欲收集或利用未成年人（minors，依新加坡法規，指低於21 歲者）的個資，可參考 PDPC 網頁上公布的準則，除了考量其他可能適用的法規，也必須通盤考量未成年人的成熟度、所為活動的本質與行使同意權的後果（Personal Data Protection Commission, 2020b）。PDPC 進一步建議參考美國的兒童線上隱私保護法（Children Online Privacy Protection Act, COPPA），以 13 歲作為企業是否需要取得未成年人的父母或監護人同意的分野。

企業欲收集或利用13 歲以下使用者的個資時，應獲得當事人的父母或監護人的同意（Personal Data Protection Commission, 2020b）。

PDPC 網頁針對個人與企業提供各式隱私與個資保護教學資源如漫畫、遊戲、宣傳手冊、海報或影片等（Personal Data Protection Commission, 2020c）。宣傳手冊透過漫畫讓使用者瞭解何謂個資以及個資保護法的適用範圍；亦另外說明

「同意權」的意義，當事人如何撤回同意權、要求存取或更正被收集的個資。線

上遊戲以60 秒為限，遊戲者必須於有限時間內依據遊戲指示判斷該不同情境下適合提交的個資內容。舉例而言，若企業收集資料係以「聯絡」為目的時，我們可以提交行動電話號碼，而不是基因圖譜（DNA profiles）或指紋。此外，PDPC 也提供五個關於網路安全的教學活動單，活動單裡除了相關漫畫、填字遊戲，也包含可與父母討論的議題，例如哪些資料適合刊登在社群網路上（Personal Data Protection Commission, 2020c）。
