一、 檢索方法與檢索結果

為映證 CardioNet 的專利策略,以公司名稱「CardioNet」為關鍵字於專利資 料庫進行檢索,包括美國 USTPO15、歐州 EPO16、日本 JPO17、世界智慧財產權 組織 WIPO18等專利資料庫。檢索結果以專利數量表示如下表 28,共 95 筆專利 資訊,其中美國專利超過一半。

4. Provisional Application:暫時申請案,申請人得在一年之內提出正式審查。

一方面顯示出 CardioNet 開發 MCOT™,在技術方面,著重於通訊技術的運用、

心電圖分析演算法,與資料處理流程。通訊方法與資料控管流程,單就專利權利 項來看,本研究認為,大部分僅是在現有技術上稍作修改的應用,技術層次不高,

但卻充分彰顯出作為商業模式專利的本質。然而這些專利都不是關鍵專利,即便 設備間不能雙向傳輸、心電圖計不能從遠端控制,競爭者還是可以推出一個單向 傳輸,設計簡單的遠距心電圖監測系統。

從佈局國家來看,CardioNet 以申請美國專利為主,並透過申請 PCT 進入歐 洲、日本、家拿大、澳洲,與中國等。CardioNet 只有在美國營運,卻大範圍佈 局專利,顯示對其對自身的產品、技術、專利相當認同,具有市場潛力。然而在 CardioNet 尚未獲利的情況下如此大幅度的申請專利,擴大財務缺口,也未必為 明智的選擇。

陸、 結論

從結果面來看,CardioNet 比起 LifeWatch 是失敗的。兩間公司的商業模式 類似,但是 CardioNet 投入較多研發經費,期望建立穩定、功能強大的遠距心電 圖監測系統。LifeWatch「借用」使用者的電腦、手機作為執行軟體與傳輸資料 的媒介。由於使用者的電腦、手機品牌不一,品質不定,不一定都能隨時傳送資 料,與 CardioNet 特製的手持 Monitor 相比,MCOT™顯得更穩定、便利。然而 自製一個中介裝置,無疑增加研發成本,與硬體成本,再加上必須自付傳輸費用 給 Qualcomm,造成成本過高,當保險給付降低時,就無法獲利。

此外,CardioNet 的通訊技術採用 Qualcomm 子公司 nPhase 提供的通訊平台,

在 nPhase 支援的範圍內,即便在沒有使用無線網路與 3G 通訊的地方,都能夠使 用 MCOT™,提升 MCOT™的競爭力。但相對的,若欲將 MCOT™推銷至全世 界,則必須受限於 nPhase 的服務範圍,對 CardioNet 不利。

整體而言,本研究認為 CardioNet 缺乏完整的策略規劃,以至於開發出「東 西很好,但是太貴」的產品;生產與銷售都在美國,系統未必能夠在國外使用,

驗就可以與保險公司取得合約,但是 CardioNet 卻因此進行臨床試驗,從結果面 來看,是不必要的成本。倘若能夠在一開始能夠有更完善的商業計劃,今日或許 能夠有更好的營運表現。
