第四節、研究限制與展望
壹、文獻資料方面
統合專利制度與統一專利法院制度將是自 1977 年歐洲專利公約生效以來，
歐洲專利制度所發生之最大變動。然因為統合專制度與統一專利法院制度尚未 開始實施之故，各種規範與後續的施行方式仍在密切討論中。本論文所採用之 第一手資料，大部分來源為歐洲專利局官方網站及歐洲統一專利法院之官方網 站所提供之草案與條文，兩網站通常依其委員會開會所決議之內容，不定時放 置所討論之決議於官方網站中。
就學術論文方面，自 2013 至 2016 年間之論文討論，大部分多為比較探討 統合專利制度與現行之歐洲專利公約制度，進而評價歐洲專利統合制度之優 點。對於統合專利制度可能產生之困難性及後續施行之建議，學術論文對此之 著墨較少。本論文認為，其可能原因為歐洲統合專利制度雖最初在 2014 年 1 月 預定施行，但迄今仍未正式生效。因此現階段的文獻多著重於制度等面向之介 紹，而在實體建議與分析之問題的部分，可能要等到正式生效時才會被廣泛討 論。
由於探討歐洲專利制度之中文文獻數量不多，故本論文以英文文獻為主要 之參考資料來源。另外，因歐洲專利公約與統合專利制度等歐洲專利制度之第 一手資料係來自於歐洲專利局與統一專利法院之官方網站。故本論文大量引用 上述兩網站之官方資料，以期獲得最為正確之歐洲專利資訊。

貳、未來研究建議
歐洲統合專利制度之未來發展上，本論文認為英國與歐盟各國之後續互動 可能會對歐洲統合專利制度得否順利實施產生重要影響。誠如本章第一節引述 Philip Westmacott 之專欄內容，因英國真正完成脫離歐盟之手續恐費時數年之 久。因此，若英國在其仍為歐盟會員國之時間內，批准統一專利法院條約，再 加上德國及另外任一個歐盟會員國亦完成統一專利條約之批准，歐洲統一專利 法院制度最快可望在 2017 年正式施行。
在未來研究建議上，本論文認為歐洲統合專利一旦施行，必定對於歐洲專 利市場產生極大的影響。因申請專利費用下降與統一專利法院之專屬管轄權，
將可吸引更多歐洲專利之申請者，然後續亦可能引發如專利流氓等問題。因 此，後續研究宜密切注意統合專利制度對歐洲專利市場，抑或是全球專利市場 所造成之影響，以提供我國廠商之專利策略建議。
