第二節後續研究建議

雖然目前軟體專利與商業方法專利在下級法院與涵蓋商業方法專利過渡期複審程序因專利適格性問題而無效的比例仍未有下降的趨勢，但在美國專利法及美國最高法院皆尚未明確否定軟體專利與商業方法專利為不受專利法所保護之標的時，仍須隨時關注美國最高法院及下級法院實務對於此一問題時之見解變更，

例如目前聯邦巡迴上訴法院 SAP v. Versata 一案已由專利權人提出上訴至最高法院的請求，因此若未來最高法院准予審判，將可能針對目前各界軟體專利與商業方法專利適格性判斷上仍有模糊空間之難題，做出更明確的解釋。
