第二節 未來研究方向

有關本案例未來可能的研究方向,有以下幾點可以觀察。

最重要的一點是,鑒於推動制定《農民權及鄉村勞動者權利宣言》的倡議尚 在進行中,將來是否會真的產出《農民權與鄉村勞動者權利宣言》或公約,仍有 待持續觀察,並可持續觀察倡議團體對人權理事會接下來的倡議活動如何進行。

另外,有關工作小組應當如何修訂宣言草案的內容,也是一個值得關注的面 向,長年關注農民權議題的學者 Christophe Golay 曾建議當他們在討論《宣言》

草案時,可以試圖藉由援引在其他文件中已被接受的字眼,另外宣言除了認可新 權利外也認可部分已存在的權利 ,Golay 教授認為可以從國際人權法(條約、宣 言及軟法文件)以及其他國際文件中(如在聯合國糧農組織或國際勞工組織中發 展出的),找到可以適用在「農民權與鄉村工作者權利宣言」的聯合國通用語彙,

Golay 教授的這份報告顯示這些通用的語彙可以協助更精確地定義宣言的內容,

另外,由於代表團曾在工作小組會議中,討論「糧食主權」此一詞彙的適用性以 及是否可改用其他詞彙取代,糧食主權這個概念到最終是否仍會被納入宣言還是 未知,如果納入了,是否會對整個世界的糧食體系產生重大衝擊,亦值得觀察。

第三,在人權理事會的各個國家集團或國家面對此宣言倡議的態度是否會轉 變,仍是一個可以觀察的重點。我們可以觀察個別國家態度的變化是受到什麼影 響,本文中所提到瑞士態度的變化,是來自於倡議團體對政府的遊說、對社會吸 引認可,再加上學院的支持,讓瑞士的態度有了改變,此後我們仍可繼續觀察會 否有其他國家出現類似的轉變,或是進一步瞭解這幾個因素中,到底哪一個是最 關鍵的原因?是由於政府中官員支持的態度?抑或是公眾輿論的支持對政府帶 來了壓力。再者,我們可以觀察不同國家集團立場的變化及結盟的情形。

最後,倘若真的通過此宣言,研究者可繼續觀察該宣言在國際人權法架構中 的定位,以及宣言通過之後個別國家接受並納入國內法或影響其農業政策的情形。
