2000 年 9 月 22 日國會通過 2001 年 1 月 1 日開始執行

1. 公共建築物定義

「公共建築物」係指建築物或其部份作為

（1）劇院、公共圖書館、大廳或其他公共使用之場所

（2）學校或教育設施

（3）公共用宗教崇拜之場所

但是建築物或其部分做為商店、倉庫或居住使用，雖公眾偶而會進入使用，並不 視為公共建築物。

2. 建築工程之意義

在本規則中，建造工程之意義為

（1）建築物之增建或擴建

（2）建築物內設備（浴廁、给排水、電力系統等）之增設或擴充

（3）建築材料或設備變更

（4）建築使用變更

（5）建築物外牆隔熱材填塞施工

建築材料變更，在防火及逃生避難、無障礙環境部分，在原來符合規定者，變 更後仍須符合規定，原來不符規定者，變更後不得較原來差。

3. 建築工程相關規定 建築工程之執行必須

（1）符合本技術規則附件一，及相關法令之規定

（2）建築增建、材料變更，或設備之增設或擴充，完成後之建築物必須符合本規則 附件一之規定，或至少不得較原來更差。

Building Regulation Definitions

1 . Meaning of public building

In these Regulations "public building" means a building consisting of or containing -

(a) a theatre, public library, hall or other place of public resort;

(b) a school or other educational establishment not exempted from the operation of building regulations by virtue of section 4(1)(a) of the Act; or

(c) a place of public worship;

but a building is not to be treated as a place of public resort because it is, or it contains, a shop, storehouse or warehouse, or is a dwelling to which members of the public are occasionally admitted.

2. Meaning of building work

In these Regulations "building work" means - (a) the erection or extension of a building;

(b) the provision or extension of a controlled service or fitting in or in connection with a building;

(c) the material alteration of a building, or a controlled service or fitting, as mentioned in paragraph (2);

(d) work required by regulation 6 (requirements relating to material change of use);

(e) the insertion of insulating material into the cavity wall of a building;

(f) work involving the underpinning of a building.

(2) An alteration is material for the purposes of these Regulations if the work, or any part of it, would at any stage result -

(a) in a building or controlled service or fitting not complying with a relevant requirement where previously it did; or

(b) in a building or controlled service or fitting which before the work commenced did not comply with a relevant requirement, being more unsatisfactory in relation to such a requirement.

(3) In paragraph (2) "relevant requirement" means any of the following applicable

3.requirements of Schedule 1, namely - Part A (structure)

paragraph B1 (means of warning and escape) paragraph B3 (internal fire spread - structure) paragraph B4 (external fire spread)

paragraph B5 (access and facilities for the fire service) Part M (access and facilities for disabled people).

4.Requirements relating to building work

(1) Building work shall be carried out so that -

(a) it complies with the applicable requirements contained in Schedule 1; and (b) in complying with any such requirement there is no failure to comply with any other such requirement.

(2) Building work shall be carried out so that, after it has been completed - (a) any building which is extended or to which a material alteration is made; or

(b) any building in, or in connection with, which a controlled service or fitting is provided, extended or materially altered; or

(c) any controlled service or fitting,

complies with the applicable requirements of Schedule 1 or, where it did not comply with any such requirement, is no more unsatisfactory in relation to that requirement than before the work was carried out.

本技術規範計十章，一至五章適用於住宅以外之建築物，六至十章則特別針對住 宅建築物。

1.1 坡道必須要符合以下規定。

a. 坡道的設立要明顯，其使用方法要標示清楚；

b. 坡道與其樓梯平臺間的斜度，需依照表 1 與圖 3 的規定；

c. 坡道的長度不可超過 10 公尺，或其增加的斜度超過 500 公釐；

d. 為輪椅使用者提供代替通道的方法，譬如：當總斜度超過 2 公尺時，可採用電梯；

e. 介於牆面、豎柱，或路邊石的路面寬度需至少在 1.5 公尺；

f. 坡道的路面止滑，這在路面潮濕時，特別需要，並且在階梯的平臺間也需以不同的 顏色做區隔；

g. 坡道與樓梯平臺的路面，所使用的摩擦材質要類似；

h. 位在坡道前後的階梯平臺，至少要有 1.2 公尺長，並且無晃動的門或其它障礙物；

i. 任何中間平臺至少要有 1.5 公尺，並且無晃動的門或其它障礙物；

j. 當輪椅使用者無法從坡道的一端看到另一端，或者坡道上有三個以上的坡道時，其 中間平臺至少有 1800 公釐寬，1800 公釐長時，可將其視為讓車處；

k. 所有的平臺都必須是等高的，且沿著坡道上的最大斜度需在 1:60，而其最大橫向坡 度在 1:40；

l. 在坡道兩旁需設有扶手；

m. 面朝坡道或平臺的方向要有路邊石，且至少要有 100 公釐高，其顏色必須與坡道或 平臺成視覺上的對比，其它的防護措施在 K 部份將會有所要求；

n. 當坡度隆起超過 300 公釐（等同 2×150 公釐的臺階），就必須設立標示清楚的臺階。

附錄四 美國無障礙建築環境法令

附錄 4.1 美國身心障礙者法與無障礙建築環境相關概要

1990 年公布

由於美國有 43,000,000 人具有身體或心理之障礙，且此人數隨著社會高齡化將 持續增加，調查顯示這些身心障礙者在日常生活中受到歧視、孤立及不公平之待遇，

所以美國在 1990 年發布身心障礙者法。

禁止在工作、寄宿、政府之服務、及通訊等因身體或心理障礙而受到歧視，美國 障礙法案提供廣泛之公民權保障個人不致因障礙而受到差別待遇。本法案涵括之範圍 較其他傳統之可及性法令規定或規範更為廣泛，不但包括建築物及設施，更包括計畫 及服務等，同時其他法令多僅針對新建之建築物，本法案更包括既有建築物及建築物 之修建、變更等。

美國身心障礙者法包括五大部分：1.工作權 2.公有建築物及設施 3.私有建築物及 設施 4.通訊設施 5.其他。本法案訂定分級之設置標準，如政府所屬之建築物及私有建 築物之設置標準不同，而新建之建築物及既有建築或建築物變更之要求標準亦不同，

對政府所有或新建之建築物或設施要求之標準最高，對計畫及服務亦依據本法規訂定 不同之標準。

綜合本法規定，其目的及與無障礙建築環境相關之重點說明如下：

1. 目的：主要係為宣示一個清楚且完整的國家政策，以強烈且一致的規定，加強相關 法令之推動整合，使身心障礙者在日常生活中不致受到歧視。

2. 內容：本法案主要分成五個部份，包括工作、公共服務、公共使用之建築物及私人 提供之服務、電話通訊等，以確保身心障礙者在前述部分，不致因身心功能之限制，

無法享有其應有之權利。

3. 無障礙環境相關規定：有關無障礙建築環境部分規定在第三部分中，規定旅館、餐 廳、集會堂、商店、洗衣店、車站、博物館、公園、學校、社福機構、及體育館等，

必須達到無障礙建築環境。

4. 設計指引：為推動本法，特別制定無障礙環境設計指引（The Americans with Disabilities Act Accessibility Guidelines，簡稱 ADAAG），以作為建置之參考 規範，指引雖非強制性，但為法院判決之重要基準。

The Americans with Disabilities Act of 1990

SEC. 2. FINDINGS AND PURPOSES.

(b) Purpose.--It is the purpose of this Act--

(1) to provide a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities;

(2) to provide clear, strong, consistent, enforceable standards addressing discrimination against individuals with disabilities;

(3) to ensure that the Federal Government plays a central role in enforcing the standards established in this Act on behalf of individuals with disabilities; and

(4) to invoke the sweep of congressional authority, including the power to enforce the fourteenth amendment and to regulate commerce, in order to address the major areas of discrimination faced day-to-day by people with disabilities.

SEC. 101. DEFINITIONS (10) Undue hardship.--

(A) In general.--The term "undue hardship" means an action requiring significant difficulty or expense, when considered in light of the factors set forth in

subparagraph (B).

(B) Factors to be considered.--In determining whether an accommodation would impose an undue hardship on a covered entity, factors to be considered include-- (i) the nature and cost of the accommodation needed under this Act;

(ii) the overall financial resources of the facility or facilities involved in the provision of the reasonable accommodation; the number of persons employed at such facility;

the effect on expenses and resources, or the impact otherwise of such accommodation upon the operation of the facility;

(iii) the overall financial resources of the covered entity; the overall size of the

business of a covered entity with respect to the number of its employees; the number, type, and location of its facilities; and

(iv) the type of operation or operations of the covered entity, including the

composition, structure, and functions of the workforce of such entity; the geographic separateness, administrative, or fiscal relationship of the facility or facilities in question to the covered entity.

SEC. 102. DISCRIMINATION.

(a) General Rule.--No covered entity shall discriminate against a qualified individual with a disability because of the disability of such individual in regard to job application procedures, the hiring, advancement, or discharge of employees, employee compensation, job training, and other terms, conditions, and privileges of employment.
