二、嚴密之法規政策保護：澳洲對電視運動轉播相關規範
相較於歐盟的政策保護模式，澳洲對於運動轉播的規範強度更高。澳洲聯邦 政府關於運動轉播的規範特性為：（一）基於「首要選擇（first choice）」途徑，
使無線廣播擁有轉播優先權，避免付費電視業者取得主要賽事清單中運動賽事之 專屬轉播權；（二）澳洲的主要賽事清單中所包含之運動項目的範圍與數量，相 較於歐洲更加專屬排他（Smith ,Evens&Iosifidis ,2015 ,p.728）。歐洲之項目清單 約少於100 個項目，然而澳洲之項目清單（2006 年-2010 年）則有超過 1800 個 賽事活動規劃於清單內（DBCDE,2010），規範的密度與廣度都更為嚴謹。
〈1992 年廣播服務法〉（Broadcasting Services Act 1992）第 115 條之反虹吸 條款，授權傳播部長（現為寬頻傳播數位經濟部會，department of broadband communications and the digital economy）保障免費提供特定類型的節目之權利，
部長可於政府憲報（Gazette）刊登「民族重要性與文化顯著性之運動賽事活動」
清單，該賽事之電視轉播必須免費提供於大眾（Evens, Iosifidis & Smith, 2013, p.130）。主要賽事清單最早於1994 年正式公布，廣泛包含各式各樣的運動項目，
如賽馬、澳式足球（Australian Rules football）、橄欖球聯賽（rugby league）、橄 欖球聯盟（rugby union）、板球、足球、網球、籃網球（netball）、籃球、高爾夫 球以及賽車等，此後據此小幅增修其內容；2006 之修正清單稍微減少所涵蓋之 賽事數量，同時增加大英國協運動會（Commonwealth Games）與夏季奧運賽事；
為了「全面檢討反虹吸機制」，澳洲政府於2010 年提出新的清單（Evens, Iosifidis
& Smith, 2013, p.108、130-131），即《2010 年廣播服務項目第一號備忘錄》
（Broadcasting Services (Events) Notice (No. 1) 2010），此備忘錄自2010 年公布後，
逐年增修項目內容，至 2015 年已有 10 次之多。2012 年寬頻傳播數位經濟部會

探究澳洲之法規政策執行成效，所謂的「首要選擇」並不保證清單所列之運 動項目在無線電視播放覆蓋率（coverage），僅為無線廣播業者擁有優先付費電 視業者的取得轉播權機會之擔保（Evens, Iosifidis & Smith, 2013, p.108）；〈1992 年廣播服務法〉第二章第六節第 10 條第一項 e 款規定，29除了國家電視台以及

普及率超過百分之五十之商業電視台外，付費電視業者不得轉播清單項目之內容，
否則將不予發照，係利用換照規定防止付費電視台取得轉播權利。依據前述等規 定，澳洲政府並不直接由公權力分配清單賽事的播放平台，而係令無線電視保有 優先權利，付費電視亦無法擁有列於清單項目之賽事專屬轉播權，藉以平衡付費 電視與無線電視間的競爭關係。
澳洲聯邦政府自1989 年開始定期制訂運動政策，由負責推動國家運動政策 之專責機構澳洲運動委員會（Australian Sports Commission，簡稱 ASC）制訂四 年一期的策略計畫（行政院體育委員會，2006 年 12 月）。根據 ASC 2013-2014 年度報告，為改變轉播生態，ASC 開始著手多樣運動數位平台可行性研究
（Multi-sport digital platform feasibility study），研究發現，多樣運動數位平台可 使未擁有轉播權利的國家運動組織（National Sporting Organisation）有接近入門 轉播之可能；並且作為進階隨選內容服務的基礎，具有商業化的潛力，因應新科 技的發展，未來的轉播生態有更多之可能（ASC，2014）
