第六章 結語與未來發展
自從網路數位時代開啟後，傳統的著作權法已不足以應付愈來愈多新興的網路著 作權課題，而科技鉅子 Google 因使用他人著作內容而引發的法律爭議，早已從 2000 年起風波不斷。這些新興力量的崛起，迫使傳統產業須重新調整與因應，以避免被科 技的洪流所淹沒，對於法律界而言，重新調整現有規範以順應時代的改變也是相當重 要的課題。科技的發展始終來自於人性的需求，而法律的規範也需要觀察民意。如何 使各界的利益彼此達到平衡，對於著作權法而言更是重要。
本文透過歷史背景的介紹，逐步推演出新聞出版業者與 Google 旗下的新聞聚合平 台與搜尋引擎間，關於使用新聞的爭議：新聞聚合平台及搜尋引擎的崛起，對於過去 習慣獨佔新聞利益的新聞出版業者，與新聞聚合平台及搜尋引擎分享利潤似乎難以接 受，且兩方對於利潤的協調一直採取著強硬的態度，關於新聞聚合平台對於線上新聞 網站收益的影響，雙方各執一說，導致談判無法令雙方有滿意的結果。新聞出版業者 為了更強力的捍衛自身權益，採取政治與法律途徑，推動新聞傳播附屬著作權的創 立。在這場爭奪戰中，雙方皆希望能夠獲得最多的新聞利潤，而新聞業者透過政治遊 說將此使用爭議推入著作權法的領域處理，期望藉由著作權法的牽制，奪回被 Google 瓜分的新聞利潤。新聞傳播附屬著作權法最初於德國通過，接著西班牙立法者亦跟 進、並制定更嚴苛的著作權法，限制新聞聚合平台與搜尋，然而該著作權法非但未能 如新聞業者所預期的，達到補償新聞業者利益的效果，反而因使用者流量暴跌而使得 新聞業者遭受大幅損失。歐洲的新聞產業組織、特別是以德國為首的新聞業者，卻依 然堅信該著作權法能夠為新聞業者爭取利益，欲進一步推動新聞傳播附屬著作權法在 歐洲其他國家的立法。
除了本文所竭力討論與分析的新聞傳播附屬著作權法之立法問題外，更進一步需 要思考的問題在於，新聞業者與 Google 之間關於新聞內容的使用問題，是否屬於著作 權法的領域？以著作權法來處理是否恰當？筆者認為，由於 Google 在使用新聞內容的 方式上，並未違反現有任何的著作權法，且藉由科技技術有效的傳播新聞資訊，促進 人類知識的流通，提升人類整體社會文化的進步與發展，非但沒有違背著作權法的基 本精神，反而是落實了著作權法最根本的、為提升人類文明社會進步的核心理念。然 而，在實際上新聞業者與 Google 之間的確存在著利益的角力，該問題本質上不應由法 律干涉，而應透過市場的秩序來加以解決。新聞傳播附屬著作權法的出現，是兩者間 互相抗爭的一個過程，新聞出版業者既須依賴新聞聚合平台的傳播，便無法獨占新聞

產業的所有利益，反之，新聞聚合平台也需要新聞內容作為其營運平台的基礎。兩者 僵持不下的結果，附屬著作權法的出現將造成兩敗俱傷。在一番抗爭之後，對於兩者 之間紛爭解決的路徑將更加明確，唯有互相合作、彼此妥協，才是唯一的解決之道。
而在附屬著作權法出現之後，Google 的確對於兩者的合作關係更加釋出善意，於 2015 年 4 月成立數位新聞創新基金，期待能為兩者未來的合作之路建立良好的基礎，並打 造優良的網路環境，共同提升新聞產業的品質。透過數位新聞創新基金的方式，或許 能暫時緩解兩個商業模式間的紛爭，然而更根本的問題在於，新聞業者需要提升新聞 本身的品質，運用網路科技的力量行銷新聞，強化自身的議價能力、降低對於新聞聚 合平台的依賴程度，才能有效解決兩者之間的紛爭，並使得網路新聞生態圈達到平 衡，在與新聞聚合平台彼此的正向循環合作之中，有效促使整體新聞環境的進步，如 此方為解決問題的根本之道。
未來，Google 所成立的數位新聞創新基金，是否能夠有足夠的成效，尚須進一步 的觀察；歐洲各國的立法者，能否有效抵抗新聞業者組織的游說力量，不讓著作權法 捲入商業角力之中，亦尚待實務界的努力。雖然台灣尚未出現該股勢力的聲音，然而 網路無遠弗屆的力量，以及台灣新聞產業衰退的事實，都與歐洲該著作權法出現的背 景相似，希望透過研究歐洲紛爭與立法的情況，使台灣法律界亦重新檢視網路新聞使 用的相關問題，以期在未來發生類似爭議時，能有更完善的解決之道。
