等問題，卻是可以在短期內透過談判、協商或交涉等方式達到利益分配的目的；
若是一昧地講求主權歸屬，反而可能無法達到解決問題的目的。
另一方面，從談判的角度來看，目前中國大陸與日本間，在釣魚台維權方面 的動作不斷，可能是試探對方底線，也不斷訪問己方及對方盟友與拋出新的議 題，來藉此爭取支持並臆測對方真正意向與能力，因此其相互叫陣的「目的」， 可能是在拉開陣勢、積蓄籌碼、準備談判。
第三節 研究展望
由於釣魚台主權一直是中台日所堅持的核心利益，即使有專家提出採南極模 式或北海油氣開發案例，惟始終不能打動中國大陸與日本對於釣魚台主權的爭 奪，目前中國大陸與日本對於釣魚台的管理有形成交叉巡邏的趨勢，台灣在這次 危機中，一直無法進入議題核心，但是所推動之東海和平倡議及相關危機溝通確 為危機處理的重要工作。由於國際政治及外交政策危機的處理，必須建構在安全 和平的基礎上，才能避免「以牙還牙」的策略不斷重複上演，達到良好的結果，
展望未來，希望能藉由對國際社會的宣達，影響中國大陸與日本的思維，轉變危 機態勢，共同為區域和平努力。
至於「防空識別區」，因非屬於國際法有關國家領空之一部分，國家應不得 於其領域外實施管轄的，日本所片面宣布的「防空識別區」已經是歷史產物，隨 著國際互動往來與科技的發展，展望未來，「公海自由原則」將逐漸受到重視，
也更需要人類的智慧來解決防空與航道安全及保安問題，而非利用軍事威脅的角 度威脅其他國家。
第四節 建議事項
「防空識別區」起源於二次大戰，以美國為首的盟國依據地緣關係，並考量 其本土防衛戰略，單方面設立的軍事行動預警範圍。但是在釣魚台主權爭議的議 題裡，「日本防空識別區」達東經 123 度，與台灣防空識別區相鄰，並涵括整個 釣魚台範圍，也跨入「台北飛航情報區」，形成一旦釣魚台區域內有緊急安全或

有保安狀況時，台灣似乎無法直接派遣船艦或航空器協助救援，反而必須仰賴日 本的協助，造成事權無法統一管理的困境，並對於台灣在釣魚台主權宣示的行動 上形成了某種程度之障礙。
由於「防空識別區」屬於單方面設立的國防預警範圍，在國際法上並未賦 予定位，若能將台灣的防空識別區擴大至東經 124 度，與日本防空識別區相重疊 於東經 123 度及 124 度間，不但不會違反國際法慣例或原則，亦將可解決「台北 飛航情報區」與「台灣防空識別區」的事權統一及飛航事務管理之問題；雖此舉 可能引發台灣與日本在治理區域範圍的對峙，但只要雙方落實不相互攔截、不要 刻意挑起爭端、強化互信機制等作為，亦可減低對台日友好關係之影響。
綜上，台灣這種單方面擴大防空識別區的宣告，對日本而言，非但不會影響 其防空識別區之功能，亦可與台灣維持良好關係；而台灣亦可達到釣魚台主權宣 示的目的，並可作為未來釣魚台主權、資源或戰略等議題的談判籌碼，值得政府 列為政策採行之參考。
