國際移民規範的研究

筆者原來想進行的是一般移民的研究，原來認為專業移民問題不大，政策上 能夠著力的地方不多。然而在周桂田指導教授的建議下，著手進行專業移民研 究，發現問題點還是相當多，政策上可以努力的地方也不少。這要感謝周教授的

「強力建議」。

不過回顧現實世界，國家之間競相爭取強勢者（所謂優秀人才），排斥（不准 移入）或剝奪（以苛刻的條件移入）弱勢者。這種情勢下，強勢的人比弱勢的人 得到的好處，已經超越馬克斯以來就國家內部階級分野的論爭。福利國家是資本 主義國家對於降低階級差異、幫助弱勢的有效回應。但是在全球化時代的影響 下，國家本身也捲入全球性資本主義競爭的活動中，成為「競爭國家」（competition state）（Lavenex, 2006：31)。從新加坡的移民制度可以看出國家不是要彌平階級 差異，反而是階級差異的加強者。

移民代表人民對於居住地與居住國選擇的自由意志的行使，全球化與民主化 帶來的便利性是這個時代的人的福氣，我們不應當走回頭路。如何解決「競爭國 家」的負面作用，筆者從本研究中得到一些想法，認為應當可以由研究移民的學 者專家共同努力繼續發展。

筆者認為訂定兼顧現實與正義原則的國際規範是有相當的正面作用的。這種 國際規範很難強制執行，但是作為「準則」（Guide Line），還是可以發揮相當的 作用。現有的規範包括聯合國對難民處理的國際規範；OECD 國家已經開始對避 稅天堂以「國際稅收標準」施壓，訂出黑名單國家與灰名單國家，也初步顯示效 果。黑名單國家立刻承諾改善而改列為灰名單國家。富人避稅出走的事實，已經 開始被國家機構透過國際組織，試圖加以規範。連瑞士、新加坡這種先進國家也 被列入灰名單。香港與澳門是因為中國力保才免於列名，而在白名單中的中國還 要註明是不含香港與澳門。

對於國家如何處理階級兩端的難民與富人都可以用國際準則加以規範，沒有 理由不能對於位於中間的專業移民、勞工移民、依親移民予以訂定合理的準則。

歐盟的整合提供很多可以參考的方向。

這是很不容易的一件事，筆者期待朝此方向努力，這個世界才能更寬廣更無 遺憾的接受人民可以自由地選擇居住國的權利。國家也應當把經濟發展、民主自 由、生活環境、文化建設、國際化、教育、社會福利、保護人權作為努力爭取本 國人與移民認同的方向，而不是僅以減稅吸引移民，以保護就業排斥移民或以減 低成本剝削移民做政治上的短線操作。「競爭國家」是好事，但是應當朝更進步 的方向前進，才能給人類社會帶來更美好的未來。
