第三節 相互保險的試金石

保險公司在美國自 1970 年代爆發醫療責任保險危機後不過發展短短 40 幾 年，其是否為最適合經營醫療責任保險的組織模式仍有待觀察。然而不能 因為擔憂未來，而否定相互保險公司在我國成立的可能性，就像美國如果 沒有相互保險公司的規範，醫生也無法迅速設立相互保險公司，今日也或 許就沒有醫療責任相互保險公司的成功。因此本文認為寧可先行就相互保 險公司之制度設立完整規範，為醫療責任相互保險公司之設立打好基礎，
至於未來醫療責任相互保險公司在我國是否會成功，就留待時間去驗證吧!
第三節 相互保險的試金石
由於相互保險對於醫療責任保險具有一定之優勢性，從而本文認為 與醫療責任保險類似的專業責任保險，如律師責任保險、會計師責任保險，
在我國也可以相互保險之模式經營，蓋本文認為專業責任保險所涉及的專 業，被保險人往往比保險人會更加了解，同時其也會更加了解其風險及需 求，因此相互保險由被保險人參與經營之特性，其所提供之專業責任保險 理應較符合被保險人之需求而能促進專業責任保險之投保率，因此本文期 許相互保險在醫療責任保險的發展及成功，一方面能開拓了我國成立醫療 責任相互保險公司之契機，另一方面能以醫療責任相互保險公司作為我國 發展相互保險之試金石，刺激各種專業責任保險以相互保險之模式經營，
使各類專業人員能參與公司經營而設計出更符合需求的保單，並與股份制 保險公司在市場上競爭，避免股份制保險公司長期壟斷責任保險市場，而 可能造成為追求股東利益而犧牲被保險人利益之弊端，以健全我國之保險 市場。
