第八節、 美學功能性與角色商標之限制

三、 Fleischer Studios v. A.V.E.L.A, Inc

1930 年代,Max Fleischer 所成立的 Fleischer Studios 設計出一系列貝蒂 (Betty Boop)的卡通人物形象,並由 Fleischer 將貝蒂圖像授權於玩具、娃娃及其 他等商品。爾後,Fleischer Studio 公司將貝蒂角色的著作權與商標權出售移轉予 第三人 Paramount 公司,並於 1946 年解散公司。隨後,Paramount 公司又再度將 Betty Boop 的相關智慧財產權分別授權予諸多公司使用。

直至 1970 年代,Fleischer 家族成員再度成立新的 Fleischer Studios 工作室,

並與 Paramount 公司簽訂專屬授權契約,買回 Fleischer Studios 早先所轉讓 Betty Boop 商 標 權 與 著 作 權 。 惟 另 一 方 面 , Art–Nostalgia.com 、 X One X Movie Archive、Leo Valencia 等公司(集體簡稱為 A.V.E.L.A),同樣曾由 Paramount 公司 或其被授權人處取得貝蒂圖像、名稱之相關智慧財產權授權,並已再授權許多 海報、玩偶及服飾製造商使用貝蒂名稱。2006 年,Fleischer 向加州中部地方法 院起訴 A.V.E.L.A 未經 Fleischer 同意,使用貝蒂的名字與圖像,已侵害其著作權 和商標權,並請求損害賠償463

(二) 法律見解

1. 第九巡迴上訴法院之審理意見

2011 年,第一次第九巡迴上訴法院支持地院駁回原告商標侵權之認定,認 為 A.V.E.L.A. 使用卡通人物 Betty Boop 的名稱及圖形在各種不同商品之行為,

並未侵害 Fleischer Studios 的商標權,蓋 A.V.E.L.A. 並非將 Betty Boop 名稱作為 商標使用,而是作為一種美學功能使用。

本案法院引用了 International Order of Job's Daughters v. Lindeburg and Co.案 的見解,認為商標法並不禁止個人抄襲他人產品的功能性部分,蓋抄襲的結果 對於廣大消費者本身並不會造成不利影響:「正如同我們使用的珠寶、服飾、汽

車上皆或多或少有著某些裝飾性的標示,以標示我們情感上歸屬的團體,如我 們曾就讀的學校、我們曾造訪的地標、或我們所支持的球隊、我們喜好的酒類。

即便這些說明標示可能被作為商標使用,但不見得表示消費者即能因此相信該 商品乃源自於該商標中所述之組織。」464

在樹立這些基本原則後,International Order of Job's Daughters v. Lindeburg and Co.ㄧ案解釋了法院應如何決定行為人為商標目的或功能性目的使用:「法院 必須仔細檢視商品本身、被告的商品行銷情形、以及消費者主觀上對於被告商 品與商標權人間之聯想」465。綜上,該案法院認為被告 Lindeburg 的標識僅為讓 消費者表達自我情感歸屬的商品特徵,蓋 Lindeburg 從未表明該商品係「正統」

Job’s Daughters 的設計,或說明其與 Job’s Daughters 之間存有任何贊助關係,而 原告Job’s Daughters 亦無法證明消費者對其來源產生混淆,或曾收過任何來自於 被告方消費者之抱怨投訴。最後,由於許多其他珠寶商均有販售未經 Job’s 徵,且 A.V.E.L.A.從未明確表示該商品是正統的 Fleischer 商品或暗示兩者間有 任何贊助關係。Fleischer 亦未舉證消費者對於商品來源有所混淆,或曾收到過任

何來自 A.V.E.L.A.之抱怨投訴。因此,本案法院判定 Betty Boop 之名稱與圖像僅 僅是具有美學功能性之商品部分,並非商標,故而被告並不構成商標侵權。申 言之,Betty Boop 的角色名稱與圖式並非用以指示 A.V.E.L.A.的商品來源,而僅 為具備藝術功能的元素,使得 A.V.E.L.A.的商品更吸引消費者購買,卻與指示來 源無涉466

另外,本案法院指出若同意 Fleischer Studios 的 Betty Boop 標識可以商標權 保護,將進而排除著作權保護時間限制467。惟此一論述相對薄弱,因為著作權 與商標權的立法目的、保護要件本不盡相同,原不可一概而論,且唯有當著作 物具有指示來源的功能,方有可能受到商標法所保護。針對第九巡迴上訴法院 的第一次意見,原告 Fleischer Studios 請求第九巡迴上訴法院覆審及全院聯席審 查,發回加州地方法院重審,並強調 Betty Boop 角色圖案的保護,應判斷 Betty Boop 是否具備後天識別性468

2. 發回重審後之審理意見

關於美學功能性之部分,聯邦加州地方法院於發回更審之意見中再度援引 了Job’s Daughters 案的見解,並另以 Au–Tomotive Gold, Inc. v. Volkswagen of Am., Inc.469案為補充說明,法院解釋正因為消費者係出於某項標識的美學價值方會加 以購買,而非因未信任該商品之來源品質而購買,故而在 Job’s Daughters 案中 方會認定該標識屬於美學功能性部分,不受商標法所保護470。至於 Au–Tomotive

Gold ㄧ案,法院則援引該判決解釋美學功能性理論之發展與兩階段測試步驟 (two-step test):

(1) 首先,為確定系爭標識是否落入功能性之範圍,法院必須探討系爭標 識之顯著特徵,是否為該商品之使用目的所不可或缺,或對其成本與 品質之影響甚為重大。如是,則該特徵將落入實用功能性之範圍,而 無法被認定為商標侵權。如否,則該特徵將可能被認定為商標侵權471。 (2) 然而所謂美學功能性尚須檢驗另一問題,即法院必須決定若保護該特

徵是否會造成競爭者處於ㄧ項重大而非與聲譽相關的競爭劣勢 (a significant non-reputation-related competitive disadvantage),如是,則 該標識將落入美學功能性之範圍,而無法成立商標侵權472

加州地方法院認為,儘管美學功能性之概念在運用上受限頗多,但仍不失 為可行的理論架構。在實務上,美學功能性理論僅適用於具有美學目的且無法 用 於 識 別 任 何 商 品 來 源 之 商 品 特 徵 , 因 此 雖 然 Au-Tomotive Gold 與 Job’s Daughters 兩判決先例中分別用了不同的語句來詮釋美學功能性理論,但真正應 聚焦的問題爭議在於「使用該標識是否具有識別商品來源或相關商品聲譽之功 能」473,如否,則使用該標識即屬使用其美學功能性,從而不構成商標使用。

有鑒於此,法院遂認定被告使用系爭 Betty Boop 之名稱與圖像不構成商標使用,

蓋被告將 Betty Boop 之名稱與圖像用於 T-shirt、玩偶、及電影海報改編而來的 包裝設計方面,故 Betty Boop 之標識係改編自電影海報之裝飾性部分,為商品 美學設計之ㄧ部分。至於被告的商品行銷過程則未曾表明其商品出自於原告方,

且被告方之商品均指示其中ㄧ名被告作為共同商品來源,故 Betty Boop 本身不 具有商品來源識別功能474

若以 Au-Tomotive Gold 案之標準觀之,則被告使用 Betty Boop 之行為將被 推定為不具實用功能性,蓋被告之商品即便去除 Betty Boop 之名稱與圖像仍不 會影響其實用性。所以,法院應著眼於第二步驟,即美學功能性之判斷,且若 將該特徵作為商標保護,將造成對被告方重大而非聲譽相關之競爭劣勢,假設 被告將 Betty Boop 圖像用於商品行銷,卻欠缺使用角色名稱進行標註時,由於 移除 Betty Boop 字樣將使得海報的內容在ㄧ般消費者眼中變得不完整、毫無意 義,故會明顯造成被告方之銷量下滑之競爭劣勢。況且,Betty Boop 的文字標識 並非具有識別來源功能,故與商品來源的聲譽無關,故而阻撓被告使用相關文 字標識將導致其受有重大而非與品牌聲譽相關的競爭劣勢475
