經濟社會文化權利國際公約

1966 年 12 月 16 日聯合國大會決通過《經濟社會文化權利國際公約》，並於 1976 年 1 月 3 日生效。此公約主要保障人民之經濟、社會以及文化權利。同樣 的，公約不僅有一般人民之權利規範，亦有針對兒童權利特別保護之規定。主要 可見於第10 條、第 13 條以及第 14 條。第 10 條主要是對家庭之保護及援助，第 1 項特別指出國家在家庭負責養護教育受扶養之兒童時尤應予以保護與協助。第 3 項則規定兒童免受歧視權以及免於經濟剝削之權利。²⁶經濟社會文化權利委員會

教育應免費之規定，強調初等教育之「義務性」以及「免費性」。³²就義務性而 言，無論是家長、監護人或者國家都無權把兒童是否應受教育視為可選擇性的；

就免費性而言，即是要確保在不向兒童、家長和監護人收費的情況下提供初級教 育。因此政府、地方當局和學校徵收的費用及其他直接費用皆是對此權利之侵 害。並且國家不得以資源缺乏規避依據此條制訂計畫之義務。³³在兒童教育權 中，委員會並特別指出應保障身心障礙兒童平等接受初等、中等及高等教育的權 利。³⁴

除了第10 條、第 13 條以及第 14 條之外，於其他權利保障中，委員會在一 般性意見也特別強調兒童該權利之保障。在第12 條健康權之解釋中，³⁵委員會認 為締約國應改善兒童健康、性和生育衛生服務，包括實行計劃生育、產前和前後 保健等。此外為了促進兒童或青少年之健康權實現，經社文委員會認為締約國應 向青少年提供安全和有幫助之環境。並且，該項權利之實現應以兒童或青少年之 最大利益為首要考慮。而女童和身心障礙兒童健康權亦應確保，包含應消除對女 童健康有害之傳統習俗，包含早婚、女性割禮以及偏惠男孩，以及協助身心障礙 兒童享受有意義之生活等。³⁶

在第 11 條適當住房權的一般性意見中，委員會指出處於不利地位之群體，

包含兒童在住房權實現方面應給予優先考慮，在強制驅逐兒童時則應綜合公約第
