3. 兒童權利公約於東亞之實踐
3.2 締約國國家報告繳交情形
根據公約第 44 條第 1 項，締約國應在公約對其生效兩年內向兒童權利委員 會提出公約執行狀況的初次國家報告，其後則是每五年向委員會提出公約執行的 定期報告，委員會並在第30 次會議決議報告頁數不得超過標準頁 120 頁。167本 節主要概述日本、南韓、中國及北韓國家報告之繳交狀況，包含報告之數量、繳 交時間以及遲交與否。
3.2.1 日本
日本係於 1994 年 4 月 22 日批准公約生效，至目前為止已繳交三次國家報 告，而委員會亦已作出三次的結論性意見。根據公約第44 條第 1 項，日本應於

綜觀南韓的繳交狀況，其從初次國家報告開始便持續遲交，遲交期間大多 1 到2 年不等，遲交最久的是第二次國家報告長達 2 年之久，而南韓遲交的狀況也 影響到委員會監督締約國關於公約的執行狀況，因此委員會在關於南韓第二次國 家報告的結論性意見中即提醒締約國依照公約第44 條繳交報告是承擔公約責任 的一項重要部分，為此應準時在兩年內提交一次定期報告利委員會監督締約國公 約的執行情況。174再者，由於南韓遲交情況嚴重加上委員會審查效率問題，使得 委員會要求南韓將第三次與第四次國家報告合併提出。
此外，就報告篇幅而言，初次報告篇幅 47 頁，二次定期報告則為 58 頁，第 三及第四次合併報告則長達128 頁。與日本相較，初次和二次報告的篇幅明顯較 少，第三和第四次合併報告則超過委員會限制的篇幅120 頁，故委員會亦於第三 次結論性意見中提醒南韓往後提交之報告應符合準則要求，若提交的報告篇幅超 過頁數限制，委員會將要求締約國按照準則審查並重新提交報告。175除了篇幅以 外，南韓之報告內容大致符合委員會要求的準則格式。
3.2.3 中國
自中國 1992 年 3 月 2 日批准公約生效以來，已繳交三次國家報告，而委員 會目前已作成兩次結論性意見。根據公約第44 條第 1 項，初次國家報告的到期 日為1994 年 3 月 2 日，而中國遲於 1995 年 3 月 27 日始繳交；176第二次國家報 告的到期日為1997 年，然而中國於 2003 年 6 月 27 日始繳交；177第三次及第四 次國家合併報告之到期日為2009 年 3 月 31 日，然而其遲於 2010 年 5 月始繳

綜觀中國的繳交情況，與南韓相同也有嚴重的遲交情形，第一次及第三、四 次合併報告的遲交期間為1 年，然而第二次國家報告的遲交竟長達 6 年，第二次 定期報告的遲交也阻礙委員會對於締約國公約執行狀況的審查，於是委員會亦於 第二次國家報告的結論性意見中提醒中國應依公約第44 條準時繳交定期報告便 於委員會監督。不過委員會考慮到中國提交報告的執行困難，為幫助其趕上履行 報告義務的時間規定，委員會例外地讓中國在應提交第四次定期報告的2009 年 3 月31 日提交第三次及第四次國家報告。179不過，中國仍並未在期限內繳交報 告。
再者，就報告格式而言，初次報告篇幅為 102 頁，二次定期報告篇幅則為 109 頁，第三及第四次合併報告之篇幅則銳減至 57 頁，大致上也符合委員會對於 篇幅之限制。而比較三、四次合併報告與前二次報告篇幅之差異，主要是各個部 份的執行狀況闡述減少導致。而其他格式中國皆能符合委員會通過的準則要求。
3.2.4 北韓
北韓是四國中最早簽署並批准公約生效的國家，自公約對其生效以來，目前 已繳交三次國家報告，委員會並已就三次的國家報告作成結論性意見。初次報告 的期限為1992 年 9 月 21 日，然而北韓遲至 1996 年 2 月 23 日始繳交；180第二次 定期報告的繳交期限則為1997 年，然而其則遲至 2003 年 5 月 16 日始繳交；181

第三及第四次定期報告的繳交期限為2007 年 10 月 20 日，北韓則於 2007 年 12 月10 日繳交。182
觀察北韓的繳交情況，初次報告和第二次定期報告皆有遲交情況，且遲交期 間長達4 到 6 年，因此委員會於第二次定期報告的結論性意見中亦提醒北韓應依 照公約第44 條準時繳交報告，此外，為了讓北韓能夠彌補履行繳交報告的義 務，委員會例外使北韓在2007 年合併繳交第三次及第四次定期報告，183而北韓 對於此亦有善意回應，其第三及第四次合併報告便於2007 年 12 月幾近準時繳 交，委員會並讚賞北韓準時繳交報告行為，對於兩者的互動是一大進展。184 至於報告格式與篇幅而言，北韓三次的國家報告篇幅大致 60 頁左右，形式 上雖符合委員會要求的條約準則，實質提供的內容仍稍嫌不足，並未完全符合委 員會之要求。因此委員並於第三次國家報告的結論性意見中要求締約國依照條約 準則以及2006 年人權條約機構第五次委員會間會議通過之提交報告之準則，包 括共同核心文件以及具體條報告的準則來編寫國家報告。185
